Santo Domingo.- The Customs Agency (DGA) cannot charge the tax online purchases less than US$200 starting August 15 announced by the government, states a court ruling handed down Wednesday.

The decision by the Superior Administrative Court (TSA) orders Fernando Fernández director cannot charge the t ax until a judge hears at least two requests for a restraining order.

"The application of the measure was suspended, the Court made the decision at the start of the hearing with a statement read by the Secretary of the Court," said Laura Castellanos, spokeswoman for Dominican Republic Couriers Association.

Several civil society groups have filed challenges to the proposed tax on Web shopping in the various courts.

Just used an export calculator using US$100,000.00 of( laptop computers) as an example adding a US$1000.00 shipping cost and US$500.00 insurance cost.

Export from Dominican Republic to USA --- Duty $0.00, US Merchandise Processing fee $346.00, IRS Tax $0.00 Total cost $346.00 to import into America

From USA to Dominican Republic ------

Duty $0.00, Exchange surcharge US$13,195, VAT tax US$18,270 Total cost to import US$31,465.00 Then retailer adds profit plus another 18% ITBIS tax I think

Taxes on a LED television imported from China to get out of customs ---- Duty tax 20%, Luxury tax 10%, VAT tax 18%, Exchange surcharge 13%

So. TV imports at $500.00 +$100 duty +$50 lux tax +$117 ITBIS +$65 Exch surch = $832.00
A 30% retail mark up? 832+250=$1082+ 18% ITBIS( ?) (195) = total cost to public $1277.00

Looking at it another way from experience... One can almost save the price of a ticket to the US to buy a laptop there... US price of a laptop ~~ US$ 250 Airline to Miami US$ 400. Total cost US$650. That equals @ 43 pesos/$ ~~ 27500 pesos... about the price of a laptop here

Of course, if you need to fly to US for other reasons, buying one there is a No-Brainer

$100k worth like a store would order in the customs examples above.. I do go back and forth home to Ft. Lauderdale for about $250 r/t add another $50 to carry 80 lbs back

HP 350 laptop here at Pricesmart $981.00 USA $531.00

Samsung 46" LED TV here at Corripio $942.00 USA $497.00 weight only 31 lbs but over-sized luggage fee cost $100

Schumacher 12v battery charger Pricesmart $116.00 USA $34.00

12 LED outdoor flood lights here are $558.00 same USA $96.00

Nikon D3200 camera Pricesmart $883.00 USA $477.00

Dominican cost $3,480.00 Bought in Florida $1,635.00 plus 6% Fl sales tax $98.10 = $1,731

Savings $1749 or 50%

CAFTA-DR is a sham for US exporters and DR consumers. Duty Free is misleading when DR imposes Exchange surcharge 13%, Lux Tax to 80%, VAT 18% while the USA doesn't impose it to DR companies exporting
