SANTO DOMINGO.- The Land Superior Court’s Central Department ordered the property registry right for two people for 3.4 million square meters of land in parcel 6-004-10866, of Higüey Cadastral District10/1era, which is part of the National Park of the East’s 35 million square meters, and called "a rip-off" by the State Prosecutor..

The land, part of Dominican Republic’s most profitable protected area, is worth US$19.9 million, and is located in the La Laguna section of Bayahibe, adjacent to Club Viva Dominicus and other hotels.

Judges Néstor de Jesus Thomas Báez, president, Light Berenice Ubillas Renville de Barinas, and Marino Luis Alvarez Alonzo ruled to register with its improvements, consisting of coconuts, 2,431,059 square meters for Daniel Antonio Minaya Rodriguez, to the investment companies  Trubia S.A., and Técnicas Eléctricas y Desarrollo Integral, according to affidavit of sales conducted by the awardee to his benefit.

Juan Antonio Haché is also benefited with 1,041,822 square meters.

The Prosecutor before the Land Court motioned to overturn the ruling in the land ordering process.

Carlos Sanchez Hernandez, indicted together with 60 people on charges of tax fraud of 4.8 million Euros in Spain, known as the Marbella case, figures in the purchase of the three million square meters, whereas Ignacio Corona Ruiz figures in the name of Trubia.

"Ignominious"

Immediately, the Prosecutor before the Superior Land Court, Fermín Minaya Casilla, warned that the sentence constitutes an "ignominy" and accused the court to becoming a "rip-off."

After calling it "a juridical aberration," Minaya announced that he’ll file a challenge in the Supreme Court, so the State gets those lands back.

GC, this is normal conduct in the DR. i have a friend who lives in Puerto Plata, and he tells me that there are 3 houses built by a powerful family on government lands, and not a penny has been paid for the land (at least, not up front). it is stone age governance.

This is a constant problem in this country. There is a permissive attitude in the authorities which promote this type of illegal action and unfortunately many investors use the weaknesses in the Dominican law system to benefit from their business deals. It would be unprecedented for this action to finalize with the re-appropriation of this land back by the state. The same way many investors have lost their investments due to questionable legal procedures. That's why the state department considers this country a "failed state." "Let the buyers be aware."

Come on my bro, it's obvious that you have not idea of what you are talking about. National Parks are highly important in any country and they should not be used for commercial activities or anything like that. If you take a look to the past, you will notice the way that the environment has been negatevely changing, and the question is why?

By protecting our national parks we are definatelly protecting ourselves, in terms of environmental perspective. I'm really interested in going to work for conservation in the DR, especially for species conservation.

Let's see if the case makes it to the Supreme Court. Subero Isa is a very proud man, and seldom do we see stupid judgments up there.

Question is: will the fiscalia take the steps and put together a comprehensive and comprehensible file for the Court to adjudicate upon??

Or will someone be paid not to do his job and have a bad judgment confirmed by all levels of jurisdiction?
