SANTO DOMINGO. - The embattled senator Wilton Guerrero today said the Supreme Court ruling to dismiss charges of slander gives him an opportunity to continue waiving the flag of values and morals, "a cause of the Dominican people that we're defending."

It's the lawmaker's second court victory in just as many months, after similar charges filed by former Peravia province (Baní, south) Police commander Hilario Gonzalez were rejected late October, when Guerrero alleged the senior officer was "at the service of drug trafficking."

The legislator made a call to effectively fight crime so society walks a footpath of peace and citizen security. "We're not defending a personal cause, because it's not about any personal interest of ours, is that of preserving the customs that have given us our origin."

The Supreme Court today ruled inadmissible the lawsuit against Guerrero, filed by the ex Peravia province prosecutor Victor Cordero, also accused by the senator of having links to drug trafficking.

Dread,

This goes back to the killings in Bani of the drug gang. He stood his ground and accused the Police and Armed forces with thier involvement in it and he has stuck by his guns. If my memory serves me they also arrested his son for questioning even though he was nowhere near Bani when the "event" took place. BTW he is one of the few to escape the "Bani eye treatment".

yes, Texasshoe, but my question pertains exclusively to the guy he accused. was the guy proven to have been involved in the mess? was he indicted? if not, how could they dismiss the suit? because , if the guy is not proven to be involved, it is slander.

That my friend is the beauty of the DR-they dont tell you. Just like when you are suspected of a crime and they sentence you to jail to await arrianment- What the hell is that about. Same in Venezuela, your found not guilty so they throw you back in prison while the Government appeals the case. But is says in the story that the first set of charges were rejected because "they were groundless" so that tells me the guy being accused is guilty as hell, yet they do nothing.

My guess is not that the people accused were guilty, but rather a determination was made that the Senator's remarks did not meet the criteria to allow the suits for slander. Are the guilty? Who knows. Are they innocent? We all know the answer to this one.

Dread,

Are you familiar with the case from the 70's where a Cuban born Venezuelan citizen is accused of bombing a flight from Jamaica to Barbados and he escaped to the US via Mexico in 2005 after from escaping prison in Venezuela, he was tried three (3) times in Venezuela and found NOT Guilty each time and spent over 9 years in prison in between trials

http://www.nytimes.com/2005/05/18/national/18posada.html

Note on second page its states that Venezuela wants to retry him again

I read in some other newspaper that the grounds for dismissal were that the charges were not properly formulated, now the guy that brought the charges against Guerrero is a former prosecutor who apparently does not even know how to formulate a charge?
