Santo Domingo.-The Supreme Court (SCJ) struck down the San Francisco Appellate Court’s acquittal of two officials in the previous government accused of introducing 50,000 tons of the toxic waste rockash in Samaná (northeast) province.

The SCJ Penal Chamber ordered Santo Domingo province Court of Appeals to hold a new trial in the case against former Environment vice minister René Ledesma, and former Dominican Port Authority director Arsenio Borges. The Court accepted the challenge filed by several legal and environmental groups of Samaná, against the August 8, 2007 sentence.

The SCJ ruled against the sentence acquitting Ledesma and Borges, as to the San Francisco Court ruling that the material deposited in the ports Arroyo Barril, Samaná and Manzanillo, Montecristi, wasn’t toxic.

This material is perfectly harmless and is used in bed construction for highways world wide.

Trying to educate someone that dosen't have the capacity to understand is difficult as is in your cases.

The material has a high commercial value and therfore was sold to a buyer for road work in the DR.

There is no problem disposing of this type of material if it is not wanted, it is however wanted and is sold as a commodity.

“rockash” is a FFC material (Fossil Fuel Combustion waste) as defined by the EPA. FFC covers a wide range of ash and basically whatever crap is left when you burn a fossil fuel. The EPA considers FFC to be non-toxic and does not regulate it however in the 1990’s when they were studying the issue they did find that some FFCs did leach some metals if they were not contained but those metals and in the amounts recorded over decades do not amount to what their standard “test of proof” that damage might be done to human health.

Having said that the EPA does consider it a “special waste” and chooses to not encourage just throwing it anywhere which is why they adopt programs to educate engineers and encourage the use of FFCs in concrete uses and other uses that “fix” the potentially harmful aspects of the material if nothing more than at least the dust aspect.

I undersand Jim if it has been "one of those days" in paradise been but maybe we can go a little easy on our friends here......

There is no commodity to speak of , when you give something away for free.That means you don't want it for a reason .Right?
Why are 3 DR gvt endicted for aranging the disposal w/o gvt consultation ?You have to remember
DR is not a colony of US as PR is and are dealing on a federal level on any international issue.

Much as I hate to disagree with you on theissue of Puerto Rico, that island entity IS NOT an US COLONY. To call any geographical/political entity a COLONY is to emply that it was peopled primarily by aparent nation. in thecase pf Puerto Rico, that parent nation would be SPAIN. As a matter of fact, Puerto Rico was a colony of Spain when it lost that terrritory to the US, alongwith the Phillipines, Cuba and other island entities after losing theSpanish-American War in 1898. Since that time, ALL territories have been either offered Independence, Commonwealth Status or Statehood. Puerto Rico STILL is in the category of being a Commonwealth with the prerrogative of electing any of thethree categories mentioned.
So, in closing, if you can'tget your facts straight and post the correct information on a subject, I strongly suggest you go back to school in an effort to learn something factual about the world you live in instead of repeating false information which fits YOUR AGENDA.

to define a posesion a COLONY ,no matter who owns it . They can not vote for the presidential and have no representation in Washington DC.All they have is a poppet GOVERNOR. One thing the DR don't have. PR remindes me of Venezuela in the last 100 yrs. Had PR been a Colony of Britain they would have done more for themselves instead of depending on UNCLE SAM . As to Venezuela with all the richness of oil at least by now they could have had heavy industry that they could call it their own as well as airplains and ship industry & motor industry as well as steel.

To my knowledge.All those So. of the border are as American as you if not more . In fact more because most ANGLO Americans are 2-3 generation EUROS while the natives or precolonials were here thousand years before . So you see TB why PR can not afford to be an independent country when all was handed down to them including defence, medicare,S/S & welfare,If they choose statehood FED TAX.could brake (PR) .They had given US 17yrs tax break as of 1950 and when it was up the industries left the Island for more loop holes and had a high unemployment rate in PR. What is keeping them affloat is the PR retirees but the cost of living has escalated tremendosly.

Thelmo...Oh please give us a break. I certainly hope you are not clinging the Vespucci thing as a source of national identity & pride. I thought that went out of vogue in the 80's. You could argue that based on Amerigo's title & responsibilities we should all be called Indians ...I don't see you jumping up to claim that title.

Another point, maybe just a little bit nit-picky, but since you opened the door on that one, the "Americas" that someone else later named after Amerigo did not include Cuba, Hispañola, nor PR; why, ah precisely because Amerigo was commissioned specifically to chart the difference between those islands and the continent and the name Americas was assigned to the continent(s). So I guess that just leaves us with the name Colonials (after Colon?!?) Which I guess just takes us back to your point...I'm sorry, I've forgotten...did we settle on colony or commonwealth? I can't remember.

So to what continent does Canada belongs to as well as PR? PR never left the American Continent You made a statement tha the Boricuas made it to AMERICA before me and i was jellous of it and that there were only 3 Dominicans in NYC in 1957. I guess i was one of them out of HS and in the US army.
As to the sports,art,science,business as you said speak for themselves are not over the Dominicans. If that was the case why do BORICUAS GO TO STUDY IN DR UNIVERSITIES to become MD ?

Believe me i lived among them in NYC for a while, from 1952-1959 and i did not meet any rocket scientist among them or in the army from 1959-1962 and there after working in the MTA from
1965-2003 ,Am retired for 5 yrs now and have not come across any" super dotado"BORICUA.

Again, Puerto Rico IS NOT A COLONY of the USA. It isa semi-autonomous entity which is still under the aegis of the US Congress, there fore is dependent on that body for many political freedoms and support. Read the Google reference given previously and weep your poor little heart out. A COLONY isan entity subgegated by a "superior nation" and completely governed and controled by that same nation. Puerto Rico has been going through a metamorphysis for the past 60 years as to any political, social and economic agendas. It will continue to do so until the people themselves decide to terminate their current status andvote for either independence or statehood. The counry is still divided almost equally on the matter as you well know.
