Santo Domingo. - The National District judge who’ll enforce the prison sentences against those found guilty in the Baninter bank fraud case on Monday said it’s possible that some motion could delay the procedure, but noted that it could be ruled on without halting the detentions.
Judge Saulo Alexis Ysabel Diaz said former Baniter president Ramon Báez Figueroa and the others convicted have the right to present a motion, “but the court determines if that paralyzes it or not."
He said the hearing on the resolution that establishes the execution of the sentence and a subsequent subpoena to those convicted, "are issues that are solved in hours," though a delay can arise because "everything’s posible."
With the notification of the Suprem Court sentence in hand, received near 9 a.m. Monday, judge Ysabel said neither the Penal Procedural Code nor resolution 296, which stipulates the execution process, specify a time limit to apply it. “Clearly there’s a principle to apply the procedures quickly, as fast as posible."
