SANTO DOMINGO.- The President of the Caribbean Hotels and Tourism Association (CHTA) considers the approved legislation on the principle of public dominion over the beaches as a positive, as long as it doesn’t jeopardize acquired private property rights.
Enrique De Marchena said the Constitutional amendment doesn’t “in any way” vary the Law in effect. “The Assembly members must be congratulated for the approval of Article 13 in the new Constitution regarding the character of public dominion of the beaches, respecting private property.
In a statement, the hotelier said the Constitution ratified November, 2003, protects individual social and property rights, the same as Law 305 of April, 1968 which creates a 60 meter marine strip counted from the hide tide mark, but also protects existent rights.
Marchena said the different opinions which numerous sectors have voiced on the lawkamers’ decision don’t take into consideration the existing legislation. “It’s interesting to note that the different opinions which have been expressed on this decision is that the existing legislation regulates the right to property and the use of the beach strip as public dominion, so the strip can be only be utilized for tourism and other public uses.”

Investors R worried about Dominicans in general who will "ruin the neighborhood" either criminals o corrupt police bringing negative spillover thus hurting investments & ROI. It's all bout the money! Or protecting investors who are taking the big risks. And of course since RD Gov officials can be bought (not bribed) then you have a citizens locked out!
However, most tourist would actually enjoy a peaceful vacation along side natives (who have some degree of normalcy). But investors want to protect their investment or not build!
Don't get "it twisted" as what the real core problem is... MONEY, investment and PROTECTING THAT INVESTMENT & its RETURN%. (becuz it's NOT the girl presented in the original photo).

Of course they want the beach ban so they can make money off our counties resources. Those resources are for its citizens not for our corrupt officials to sell and make money from. Of course we want investment in the country. How about fixing the infrastructure like the electricity problems. How about fixing our educational system. How about fixing our medical system. Fix some things to benefit the people not just the corrupt and greedy pockets.

i already had that many times they sat down on my blanket with me and my wife who is also dominican... they did not LEAVE HER ALONE for even a one MINUTE. they try and eat my FOOD, ASKED ME FOR MONEY OVER AND OVER AGAIN, REALLY AFTER SOME HARSH WORDS FROM THEIR STUPID MOUTHS AND SOME TALK ABOUT SEX WITH MY WIFE PRESENT THIS ALMOST TURED INTO ONE BIG FIST FIGHT.... so u can keep beaches and let the STUPID LOCALS TRASH the place.

also let me tell u about the time 4 locals took a piss in front of my family and 5 tourists from miami. hey! i have photos of all of this and more... think im going to post these on line for the world to see. all the locals have their hands out all the time.... even if they have pesos in their pocket... u know the game dont u?

What should have been done was passed the privatization of the beach next to resort but at the same time designate public beach park area not for privatization, every province should have a public beach park accept to local and YES,,,i think they should pay to park in the area,, therefore someone can have a job of cleaning of the brugal,presidente,barcelo and garbage that is left behind by local....so yes privatezy the beach resort but at the same time should have place where public space can be enjoy by anybody that can pay RD$50 peso to park and use the public spaces.

The problem is not keeping poor people off the beaches. The problem is fixing the problem that makes them poor. For a tourist it makes no sense to come from Kansas and spend the week talking and interacting with people from Texas. That is not why we travel as tourist.
The beaches in Puerto Rico are the property of the people of Puerto Rico not some developer and that is as it should be. They the beaches are a gift from God to be shared by all those who wish to use and not abuse them.
Well paid and educated police can fix the crime problem on beaches without restricting access from it owners the people of the Dominican Republic. If a developer wants a private beach have that S.O.B. build one not steal one.

brilliant post, bearcat. kudos for a great insight. maybe if Dominicans did not feel like outsiders in their own country, they would have more respect for it, and not trash it. they would have respect for themselves, and others, and not urinate in public in front of women and children. they would not throw styrofoam containers out their car windows, etc. but, when laws allow foreigners to enjoy what they cannot, what do you think will be the result? i watched a news article last night, depicting young men and women burning tires and old mattresses in the streets, protesting the basic things that they do not have, such as ELECTRICITY. when people live in the dark, do you think they will act brightly? luckily for government, these actors are rag tag armies of uneducated people, who have no orchestration ,nor sense of direction. one day, maybe soon, some bright guy is going to harness this anger into a coherent attempt to dislodge these criminals who run the country. just watch!

The politicians of this country are poor students of recent history. They forget that Castro took and kept Cuba with less than 300 men and women. He was successful because of the history of insults that were forced on the Cuba people for the benefit of both outside and local business interest. They were aided in this by a corrupt, poorly educated and paid police and military. Does that sound familiar?
In order to demand respect from others you must respect yourself which is not happening here. Government here thinks the people are their property or in the alternative that the people work for them. The converse of that is true; the government is owned and works for the people.

I have to laugh. One fellow feels that well paid police are going to be different which is a joke. These people are thieves and if you pay them more they won't change.
Have you been to any beach in the DR on a Monday following a sunny Sunday? A freaking pig sty. I went to a beach in Nagua the day after a holiday and the garbage was a foot deep over the entire beach.
What tourist wants to associate with that type of garbage? Not the ones from Tesxas NOR the ones from Kansas. That is also NOT why they travel. It is so easy for someone to talk about the situation here when they know NOTHING about it.
If I owned a Hotel I wouldn't want to clean up after THESE masses!
Just one other thing, the government here is ELECTED by the people or maybe by the bottles of rum they hand out for the votes...

The reason they want control of he beach front is to keep you Sr. Escott away from the resorts not the litter. And the same under paid cop who can not go himself would blow your head off for the benefit of his masters.
I can go to the beach whether you allow them to be sold or not because God and hard work gave me money. You can not allow a sucker with a dollar in his pocket to take your birthright. If you do then you are not men.
Litter can and will be handled by a broom and some work.
However you do have a good point, if the beach is owned or to be owned by the People of the Dominican Republic then they need have some pride and self respect and keep their property clean. It is called pride. Pride and self respect is not about breast beating it is about work.

i was watching some guys on tv protesting the lack of services in some town, burning trash and tires. they know very few other methods of articulating their grievances, because, sadly, their masters elected to neglect education altogether, so they cannot even write an opinion letter in the daily periodicals. but, the same cops who have no lights at their homes would probably blow some woman's head off for carrying a mattress to the scene. because their masters have conditioned and formatted them to be humble servants, there to protect the powerful, and intimidate the powerless. one day, the sh..t is going to hit the fan.

The cops need not look far for their history lesson. “Baby Doc” was the man and they did all his bidding but when the man left he had money and went to France. The “Tonton Macoute” was left to the mercy of the people.
