SANTO DOMINGO.- In a milestone ruling the Superior Land Court struck down the sentence which transferred a 12.5 million square meter tract of land to individuals, located within the National Park of the East, La Altagracia and Romana provinces.

The case to recover the land, in parcel 6 of the protected area, was headed by the Attorney of the State Fermín Casilla, before the Court’s Central Department.

The company Inversiones Trubia S.A., of the Spaniards Carlos Sanchez and Andres Liétor, who are implicated in the Marbella money laundering scandal, had acquired the land for US$9.9 million, but the sale was revoked.

Judges Luz Berenice Ubiñas, Carmen Zenaida Castro and Guillermina Altagracia Marizan voided all the surveys leading to the land’s mapping and transfer and ruled against zoning lines traced within parcel 6 of Higüey Cadastral District no. 10/01, in favor of Tomas Rosendo Dantes-Castillo, which resulted in parcels 6-006-837, 6-006-838, 6-006-839 and 6-006-840, for being under areas Protected Areas laws 64-00 and 202-04.

The court rejected the sales contracts filed by Sanchez and Dantes-Castillo on February 5, 1993 for the 848.96 hectares, and one filed on February 25, 1995, for 6,500 tareas within Parcel  6-Rest., Cadastral District 10/01.

The court ruled that the 1,257 hectare tract within parcel 6 of Higüey Cadastral District #10/01, where the parcels are located, "have lost their private character and have become property of the Dominican State and of public dominion, for being protected areas, according to Protected Areas Law 202-04."

The Land Court’s ruling is the first time a transaction of that magnitude within a protected area is struck down.

this ruling has many meanings good and bad ....the greanies can be totally oppressive and anti everything ....We must be even handed and thoughtful in our ecological decisions and not allow the greanies to become the new fanaticism or Jihad that some have taken up as their new religion ...

Good, I'm not a Greenie but I agree the DR must save our natural resources at all cost. Why can't man live in a natural setting anymore ?
18 + years ago while studying the Navajo culture in Arizona and New Mexico an Elder Woman once told me "Mother Earth is alive, only take what is needed and no more, take care of Her and She will take care of you" now I know for many this may sound awkward....only because many see money and profits. She also went on to say "One can not own what God has given, We must be care takers of the Land" imagine that....The Navajo were removed from there Land and placed by the U.S Gov. in the most despicable Desert found, yet they still carry on traditions. Many today look at their lifestyles with pity, yet the Elder Navajo's look at themselves with pride and dignity and are satisfied living the old ways.
Some where along the line WE have lost something....Man Builds, Man destroys.

Fabulous news!!

DR is in great need of Greenies. We really need greanies and tree huggers. In that aspect we are few decades behind.
Now we need to dedicate ocean front for the locals, and create green belts around the country with pedestrians and bicycles paths. Then we would be talking.

As I understand it, the ruling was against foreigners, Spaniards.
Would a similar sentence have been passed if the investors had been influencial Dominicans?
