SANTO DOMINGO.- A National District court acquitted the defendants in the case of the bank Bancredito, after the Justice Ministry dropped the fraud charges against its ex president Manuel Arturo Pellerano and senior executive Juan Felipe Mendoza.

In a Monday morning hearing Collegiate Court 2nd Penal Chamber Presiding judge Ingrid Fernandez handed down the ruling after the Justice Ministry desisted from its claim.

The lawyers for Pellerano and Mendoza Arístides Trejo, Luz Diaz, Napoleón Estévez and Claudio Stephen petitioned the court to declare the acquittal, citing several provisions of the Penal Procedural Code.

To formally retire the accusation, National District Assistant prosecutor Narciso Escaño noted that the Central Bank and the Banks Superintendent had desisted from continuing the civil suit after reviewing the agreement reached between the bankers and the plaintiffs.

Detailing the agreement, the Assistant Prosecutor noted that even though the damage was caused to society and hast yet to be fully repaired, Pellerano and Mendoza cannot be held accountable, and instead the responsibility of the Central Bank officials as made public at that time, which escapes the court’s jurisdiction.

And it's not even Christmas!

Seriousle, the fact that the "parte civil" desited fron its claim does not prevent the public penal action to continue. It should actually go on.

Only a half-baked excuse to justify shenanigans that sure enough were very very expensive.

These two are not out of the woods yet. There is still jail time and to be paid pending fines on a related case, so odds are that they will stay in jail for a while more until they pay up.

Sorry to tell you my friends but they are already out of the woods, because the sentencing that took them to jail is TOTALLY UNCONSTITUTIONAL, because all the PRIVATE ACUSERS AND THE DISTRICT ATTORNEYS drop there claim in what is call Bancredito Chiquito, BUT because thers is no real justice in DR , they where sentence to jail. But thats not going to last very long, and the sentencing is going to be revoque by The Constitutional Court which is being created right know. This executives since day one they had theIr best INTENTION to pay. They signed receipts , gave guarantees deeds, sold the bank , signed a 3 party contract on 2003, which failed because of the central bank oposition after signing and know another contract....What more do people want???? INCREDIBLE!!! As the note reads they CANNOT be held accounted for the remaining damage or consecuences.........

The civil part was drop on Nov 1, 2010 and the public penal action was drop on Nov.22, 2010 they are TOTALLY ACQUITED of what is call Bancredito Grande. Crooks are people that rob things in which they´ve never invested any time or money , this family has more than a 100 years of comercial tradtiton, and they where AT ALL MOMENT in their best disposition to pay ALL DEBTS.
