Santo Domingo. - The Supreme Court (SCJ) issued a resolution ordering Instruction and Tribunal judges to be cautious when changing a restrictive measure for people accused of drug trafficking, homicide, murder, kidnapping and other serious crimes.

Chief justice Jorge Subero said the judges must weigh the fact when the accused is associated to a criminal group, or if in the case of those released on bail won’t jeopardize society’s security.

He also instructed judges to take into account if the accused could obstruct the judicial investigation or if its presumed that the defendant, once released, will rejoin the crime ring, or if the suspect will use it to make it easier to flee. He said the judges must adopt that measure, as society demands more drastic penalties against the people who commit onerous criminal.

In that regard, Subero revealed that the judges René del Rosario and Jose Alejandro Vargas are under investigation as the result of their ruling to release several suspects accused of being hired killers.

He said the SCJ will determine if they’ll be submitted to a disciplinary trial this week, as occurred with the judge from La Romana, who released on bail Ramon del Rosario Puente (Toño Leña), which the Drugs Control Agency affirms is the eastern region’s top drug supplier.

Here's the warning that was issued:

To all my fellow jurists:

If you are releasing a murderer, drug dealer, or the perpertrator of a serious crime on bail, make sure you have received your payment in cash, as these people will never show up again, unless they are found dead. Also, if you are accused of malfeasance, make sure that any picture of you that appears in the media has a prominently displayed Crucifix. (That way the funny hat guys will always give you their support.)

One more thing. Since the state is incapable of protecting anyone or anything (other than their wallets) watch your back if you decide to be tough with these criminals. You are on your own.

Too much emphasis is focus on the judges for releasing this criminals back into the streets, the dominican justice system has more hole than a guira and fixing it is going to take a a lot of pain; and as to be expected the regular display of scapegoat-ism by a funcionario who doesn't know what he's talking about.

Most judges are honest and won't take money fron narcos, but if when el fiscal makes an arrest and jumbles the evidence (or steals it) the judge doesn't have other option than to release the criminal under a financial guarantee.

Most of the times that is how criminals get away with murder and worst in DR, pointing fingers is not going to work, the problem is bigger than the judges and obviously much bigger than el boca e' burro the subero.

I wouldn't want to be too, too hard on these judges, for they might fear for their lives.

Look, some high-ranking police and military are already involved in narco-traffic, not to mention high levels of "de facto" government, so who would they trust to protect them? Think about it! Clearly, they might not have much of a choice in the matter.

We've lost our country to immorality and corruption and are effectively run by narco-traficantes.

The way I see it, we have two choices: 1) we could play victim and just accept status quo; 2) we do something about it. Which choice should we make? This is real question.

As JuanB states we're already victims and the status quo is strongly entrenched in all branches of our government, now i disagree with juan on the notion that there are no honest , hard working dedicated people in our society capable of turning this issue around, there are plenty of people like that, what we need to do as individuals is to spread the word amoung like minded people that together we're strong and we can make a difference.
Don't forget the fact that as corrupt our ELECTED officials are , they are up for re-election every four years, so it is US that ultimetly hold the power, our democracy is strong as it is, is the way we use it that is weak
We can for starters promote a public debate amoung candidates, when was the last time we seen one of those in DR?, think about it, a public debate between dominican politicos would eliminated 60% of those who are not educated enough to hold public office and are in it for the money.

Esta propuesta es en mi opinion la primera de esta indole y deveria ser respaldada por toda la poblacion no solamente por el sector industrial privado si no todos los sectores de la poblacion.
A mi personalmente me gustaria ver a la iglesia adoptar una posicion de apoyo en cuanto al debate publico se refiere, aunque muchos no lo consideran cierto, la iglesia catolica tiene mucha influencia en la politica dominicana.
El apoyo a esta idea seria una cuestion que todos los interesados en hacer algo positivo por RD deverian de unirse y empesar una campaña de respaldo en torno a un debate politico televisado.
Por ejemplo, podiamos formar un grupo de personas con el tiempo necesario y las conecciones necesarias para escribir cartas a medios de comunicacion o personalidades cuya influencia puede ayudar a que este debate se realize personas como freddy veras goico, nuria piera, alicia ortega.
hay muchas cosas que uno puede hacer para marcar la diferencia ademas de quejarse

If you look at t my postings through the years this has been among of my many rants. Especially, when LIE -onel Fernandez refused to debate during the last presidential election.

So you have my full support and I will be more than willing to lend my chicken scratch to any effort that will make this a reality!

We need to start a "grassroots" movement to elicit the kind of action that will bring about positive changes to our country, particularly in political arena. Perhaps that has already started, and I would encourage to pay closer attention to DT in next few weeks.

first of all if you ever want to be part of any group of people that is trying to promote good democratic practices you need to stop been soo political or at least show discretion when expresing your political views, you need to be objective and consider the point of view of others, that is if you want to make it work.
Remember that the advancement of democracy and social justice are bigger than any individual or political party, that's why pointing fingers or calling people names does not help the cause.

Lo primero que uno deve hacer es crear conciencia acerca del debate y tratar de reclutar gente que este dispuesto por lo minimo a ofrecer su firma, una manera de conseguir ciudadanos que compartan nuestra causa es usando el mismo metodo que usaron los fundadores de la republica, cada miembro recluta tres personas y esas tres nuevas personas se comprometen a reclutar tres cada una , asi sucesivamente en corto plazo tendriamos una multitud de gente.
