Santo Domingo.- A Sanchez Ramirez province (northeast) court yesterday sentenced Barrick Gold Corporation to pay 500,000 pesos daily until it returns more than 200 tareas (around 12.6 hectares) which it had illegally occupied.
The ruling from the Judicial District’s 1st Penal Court judge Ramon Emilio Peña Perez favors Jose Pancracio de Peña Jiménez and rejects a restraining order against Industry and Commerce minister Jose Ramon Fadul, and Mining director Octavio Lopez.
During the hearings, the Canada based mining company was represented by Augusto Chong and the lawyers Alberto Fiallo, Luis Miguel Rivas Hirujo and Juan Manuel Pellerano Gomez.
The court’s 24 page ruling states that Barrick will have to allow free access to the land’s proprietor, once the sentence is notified.
De Peña Jiménez had been demanding the return of the property for two years, and a 270 million peso lawsuit for violation and damages to private property is still pending.
The court verified that the company prevented Peña Jiménez’s access to his lands on December 5, whereas Barrick Gold’s lawyers motioned for acquittal, claiming among other considerations, the protection of the rights of property.
Property rights
The judge ruled that the State is obliged to guarantee Peña Jiménez’s right to property, because his lands were occupied by force.
Barrick Gold's operations are based in Pueblo Viejo, Cotui.

Would Barrick Gold be only guilty party here?
I doubt it. Nothing of this magnitude ever happens in DR without government tentacles leading the way. I suppose someone's been slighted and it's payback time. It would be correct to assume that this will go away in few days and everything will be forgotten, and Barrick will be mining gold in no time at all. That's the Dominican approach to business. It is how's been and how it will always be.

Yes ateo ,,it would be a good idea if the Dominicans could take an equity position in many of these projects instead of buying big cars and houses ..and it would be also a good idea if some banks or merchant banks here set up some equity funds so that Dominicans could benefit from the projects..but alas,the way of most is to simply criticise foreign investment or to take a small handout .

Is DR overtly stupid? With the examples you cite of Chile and other places, while other have cited Argentina, why did DR invite Barrick with open arms to come over and steal our resources, pollute our environment? Really-does this make sense to you or anyone? It seems to me that a great deal of the pollution Barrick Gold is accused of creating was already there from the previous gold mine operators. Word around forums is that Barrick hasn't yet taken out the first shovel of our ore.
I think Dominicans as a nation need to take a laxative to cleanse ourselves, then decide what we really want to do , become. Do we want to follow Cuban, Venezuelan, Bolivian models, or do we want to become the Singapore of the Caribbean? What is it going to be? You really cannot have it both ways.

When i said that voting in Chile was mandatory and compulsory I meant it and look up to a country that believes and practice democracy by diferent parties and changes such as now . Not only one such as ours. This guy has been placed in power 3 times already and planning to change the constitution to stay for life .To me that is a dictator that has done nothing for the country's education not to mention the least . They already call him Trujillo jr. At least Trujillo built up the country with Dominican blood and sacrifice . This guy only depends on the W/B & IMF for his projects and pacifies the country on borrowed money by building a subway that carries unemployed from point A- B It shows you what kind of mentality we are dealing with.

METRO was ill-conceived solution looking for a problem.
We are already leaving monumental debt to our children and several generations past them.
So what do we do about it now? Since it is part of modern infrastructure, let's use this monumental evidence of failed planning and governing to expand all productive sectors about it, including business, education, transportation workforce, technology, etc. Let's not dwell so much on its failure, but rather on how we culd make it more useful to nation's needs, less of a burden.
Failure-not an option!
Really, let's be empowered to define our destiny, perhaps something along the lines of Singapore. With this infrastructure in place, increased education and right type of investment, our country would really become a force to be reckoned with.
Perhaps we should start separate forum on the METRO and what to do with it and how to best make it work for the Dominican nation. Logically, Dean Josean would chair.

While I am at it, let's immediately endeavor to put at least one parsec of distance between us and tourism. It clearly behooves us to distance ourselves from this unstable industry which can shift with the wind.
Instead of being servants to tourists, why not become tourists ourselves, by increasing our GNP and per/capita income so we could travel to those wonderful and far-away places instead?
We are thinking small and, consequently, remain small and dependent on chain of bad governments and handouts. Essentially, we are volunteer modern slaves. Let's break the chain! And the sooner the better.
We need a clear vision of the future, where the people are empowered and limited only by the depth of their ambition, extent of their imagination and commitment to succeed.
Now is the time to start this movement, free ourselves from servitude in perpetuity and realize true and substantive progress.
