Santo Domingo.- With the headline “Thousands Stripped of Citizenship in the Dominican Republic,” a press release datelined NEW YORK, by the PRNewswire and USNewswire agencies mentions a case it says challenges “Dominican Republic's treatment of its citizens of Haitian ancestry,” filed before the Inter-American Commission on Human Rights today.
It said the Open Society Justice Initiative and the Center for Justice and International Law (CEJIL) case focuses on Emildo Bueno Oguis, a Dominican of Haitian descent who was refused a certified copy of his birth certificate—essential to travel, work, or access other basic services in the Dominican Republic—by the Civil Registry in 2007.
"Bueno Oguis's case is emblematic of the discrimination faced today by thousands of Dominicans of Haitian descent," said James A. Goldston, the executive director of the Open Society Justice Initiative. "The Dominican government is using a panoply of legislative and administrative tactics to deprive this population of its lawful rights. Without access to their identity documents, many Dominicans of Haitian descent find themselves essentially stateless."
Bueno Oguis was born in the Dominican Republic in 1975 and recognized by multiple state agencies as a citizen, in accordance with the law. However, since 2007, government authorities have argued that he actually does not have the right to Dominican nationality because of his parents' immigration status at the time of his birth, retroactively applying a 2004 migration law to strip him of citizenship.
A hearing on Bueno Oguis's case has been pending before the Dominican Republic's Supreme Court for more than fifteen months. After three years without essential documents, Bueno Oguis has faced unacceptable limitations on his fundamental rights, including restrictions on his ability to move freely and own property.
The Bueno Oguis case is the first nationality-related complaint to be filed against the Dominican Republic before a human rights tribunal since the Inter-American Court's landmark ruling for the minors Violeta Bosico and Dilcia Yean Oliven. In that case, the court ruled in 2005 that parents' migration status could not be a factor in determining nationality, and found the Dominican Republic's nationality policies racially discriminatory against Dominicans of Haitian descent.
"The Dominican Republic has to comply with the spirit of the Inter-American Court's decision," said Ariela Peralta, Deputy Director of CEJIL. "The new constitution raises additional concerns, and we hope that this case will spur a more productive dialogue on how the country can work to end these racist policies."
The Justice Initiative works together with partner organizations in the Dominican Republic to document denial and deprivation of nationality, raise awareness of the problem of statelessness, demand justice for victims, and advocate for modification of discriminatory nationality laws and policies.

Well the solutions to this problem is actually very simple. Follow the Dominican immigration laws and this problem would have NOT existed to begin with. Is as simple of a solution as it gets but that's too much to ask! right?
By the way the new constitution does not raise any concerns, it simple made a simple solution simpler on paper to avoid confusion. So Peralta save your whining for a case where you have a valid point because in this one is simply making a case for the new text in the Dominican constitution sound even better.

Yes, Dread but even if Pepe32 means that you of all people know that the situation is reaching the threshold before a serious situation develops in DR. Haiti's problems cannot be solved by DR. I for one would hope that a Visa or workers' permit program be implemented with the assistance of the international community. Dominican nationality must be handled by the authorities of the DR and no one else. Even in the US there is a powerful movement afoot to denied children of illegals the right to citizenship. The Supreme Court may very well rule on this matter in the not too distant future. And this problem is not unique to the US and the DR, it happens everywhere where the differences between bordering and sometimes not so bordering states have great disparities in income and general opportunities. The DR National Census will take place in September of this year and perhaps this event will help shed some light about the direction this phenomenon.

The Haitians and the the NGO's pushing for them, are persistently trying to elbow their way in the Dominican food table, as uninvited and unwelcome guests.
Dominicans and their government have to select a strong immigration policy, and a "no questions asked" immediate deportation back to Haiti, after properly making a record of the first offense.
Most 95% of all Haitian illegals cross the border with no papers whatsoever, and come to DR to give birth in our hospitals. There are even bus tours to bring pregnant women to DR hospitals to give birth. The present estimated rate of Haitian illegal immigration by independent sources is over 100,000 illegals every month. If that rate keeps constant or rising, we can kiss good-by to the DR as a Spanish speaking country, and the DR will be pulled down quickly by the mass exporting of the Haitian poor, sick, pregnant, homeless and unemployed and quickly become another failed state, with a barren landscape caused by predatory cutting of trees.

But nonetheless your point is well taken, the DR and Haiti have allowed this situation to get out of hands, and sadly, it may only take a severe event like a nasty hurricane, very possible, this year to trigger or spark a nasty series of events. In the event many hundreds of thousands of poor Haitians would walk-over and then we indeed will be witnesses to the tipping point. I for one hope this can be averted, but reasoned thoughts say this possibility is more probable than most would like to admit or feel comfortable saying so. In the end, it will take massive infrastructure rebuilding in Haiti, a strong export platform economy, and lots of hard work to begin turning around this situation. Oh, and I almost forgot to mention, Lots and Lots of luck!

Because of the Summit, there are soldiers on each corner of Bavaro, Politur, Amet. Not only normal soldiers, but Ninjas as well (soldiers dressed in black with the helmet of Lord Vader).

I have always wondered how many of those here supporting giving Dominican Citizenship to illegal aliens in DR will actually suffer or even bother to help if this were to happen.
My personal opinion has always been that the will of those working and living the everyday Dominican Republic as many of us do or did should actually be the voice to be heard above any opinion or "International Laws crap" that is getting push here. I think most of the ones "supporting it" won't ever move back to DR yet want to change it's way of running daily.
The new constitution is simply the result of what many who will suffer think.
My father now 58 Years old born, raised and living in DR (SFM) has always been against it and so have I too for the obvious reason of having something to loose if this happens. Just my opinion on the matter.

Also you miss the clear fact that the overwhelming majority of Dominicans in the US are LEGAL and even the majority of ILLEGALS are documented as entering the US (visitors visa and overstay) so the US has allowed them in and KNOWS they are in the country.
The overwhelming majority of Haitians on the other hand are not only ILLEGAL ,they are undocumented so the DR has no accounting of them ,they just hopped the fence .
Add to that the historical animosity between the nations and you cannot even begin to compare the situations.

Until Haitians respect the sovereignty of the DR there will continue to be problems. So many people don't even realize that DR cannot assume the burden for Haiti's errors. Education is necessary on a massive scale to bring Haiti at least to the third world level.
I say deport all except the ones necessary for the economy ,give those papers and deport the rest!

The overwhelming majority of Haitians on the other hand are not only ILLEGAL ,they are undocumented so the DR has no accounting of them ,they just hopped the fence .
Add to that the historical animosity between the nations and you cannot even begin to compare the situations.
