EXCLUSIVE FOR DOMINICAN TODAY

Santo Domingo.- In this follow up article on an alleged ongoing scam by the real estate company Intercaribe, and its president, Ilonka Castillo, two more investors have written us of their plight of bank forecloses on several properties worth US$20 million.

The scandal is ocurring in the residential project Villas Bavaro, located in one of Dominican Republic’s most thriving resort regions.

DT had made numerous calls and sent several emails to the phone numbers and the address posted on the Intercaribe Website, but they were all out of service, incorrectly listed, and since none responded our queries, it appears that they have simply vanished.

Letter to Dominican Today from: Isabel C. Meneses and husband

Subject: Residencial Costa Bavaro

"It’s good that perhaps that somebody finally listens to us.

If you may be so kind, please read my letter, tell me how you see it and if it’s alright I give you permission to publish what I state here.

When my husband and I bought in Villas Bavaro, specifically Villas Del Sol II, did we it through a travel company here in Miami, specifically MK Travel where Mrs. Ilonka (Castillo, DT) had come and done grand presentations in rented halls for us to buy there.

Well we did so, we bought and we signed a contract where we were promised villas and castles, Club House, only for owners, green area, security and access to the beach via the hotel Ifa and free transportation to the beach,  little of all this has been fulfilled.

The worse of all, we had to make three trips from Miami to reach the closing since our unit hadn’t been finished as we had been told.

Finally we closed and they promised us our much touted Title, it was supposed to be handed to us in no later than 90 days, when we insisted on it Mrs. Ilonka’s response to us was that they were working in that, only empty promises, when I told her that we were already tired of hearing promises, that I no longer believed in her answer was always, “My family is honest, we are one of the first "Realtors" in Santo Domingo, we deliver what we promise.”

Well, several years have already gone by and there’s still no Title, and we all already know the reason, Mrs. Ilonka didn’t use our money to settle the account of our lot with the bank, she used it at her convenience and now the bank has placed liens on several properties, including mine, according to the bank, it is ready to negotiate with the buyers.

But I ask myself, negotiate that?

I buy my property, pay what’s stipulated in the contract, why should I pay one cent more to the bank so they give me my Title? Why didn’t it charge those who embezzled with impunity, for failing to comply with all the promises they made, and those of the contract, forget them.

My question now is, What can we do, the investors who believed and trusted and have been so deceived with impunity?

I hope that somebody can help us solve this great problem, to let it be known and that something is done so this doesn’t continue happening.

Investors in Dominican resort scream swindle, vow court action

Santo Domingo.- Investors in a residential project in one of Dominican Republic’s most thriving resort regions say they’ve been scammed by the real estate company Intercaribe, and its president, Illonka Castillo, which led a bank to foreclose on several of their properties worth US$20 million.

“My wife and I constructed our "dream" home in Costa Bavaro six years ago, for the first five years the residents here dealt with constant lies from Illonka Castillo who took the maintenance money a invested it in their own investments. For months we had no security (constant robberies) no trash removal, no street lights, basically it was a mess,” said a letter by one of the investors who’ve taken legal action.

Although not the first time foreign and local investors have been swindled by real estate companies that deal with upscale properties, the fact that Ilonka Castillo is a well known public figure who appears often on television to promote the sector makes this scandal unprecedented, spurring the term “ironic” from one investor. “I am writing to denounce the abuse to hundreds of investors on the part of the real estate company Intercaribe, S.A. Ironically the same day (October 9) while the president (Leonel Fernandez) inaugurated a project symbolizing the country’s progress, Intercaribe S.A., represented by Mrs. Ilonka Castillo as its president, misappropriated hundreds of thousands of dollars.”

DT tried to call the IFA and Itercaribe phone numbers provided on its Website, they weren’t in service or incorrect, and an email didn’t get a response. We also tried to contact the Residencial Costa Bavaro office manager, Jocelyn de la Mota, but again, the numbers provided were either not in service or incorrect.

One of the investors even called the scam a “rape” occurring for the last six years, and notes that “nothing is happening,” “This Costa Bavaro has become a huge scam. The residents are furious that they are being "raped" for the last 6 years and nothing is changing.”

And although two of the investors said we could use their names, DT will await the response from those responsible for the project.

THE LETTERS TO DT:

“My wife and I constructed our "dream" home in Costa Bavaro six years ago. Since this time we have religiously paid our maintenance bills first to Intercaribe and now to the present company in charge IFA Resorts.”

“For the first 5 years the residence here dealt with constant lies from Illonka Castillo who took the maintenance money a invested it in their own investments. For months we had no security (constant robberies) no trash removal, no street lights, basically it was a mess.”

“At the present time the IFA resorts will not disclose any expenses to the property owners, the second phase looks like an "earthquake" has hit the roads. The first phase of Costa Bavaro where the IFA Resorts is located is spotless, good roads, no trash, and better security. It is very obvious that the money that the residents in the second phase is being only put to use in maintaining the cleanliness of the first phase and the IFA RESORTS.”

“When you ask about the roads they tell you maybe they will repair them next month. I, myself have offered my labor for free to fill in the holes if the stone and truck was provided. I figured it was cheaper than repairing my car. The other point is that they charge you to buy a water meter for $400 U.S. dollars when you construct a villa, and turn around and remove it if you are a day late paying the maintenance fee.”

“This Costa Bavaro has become a huge scam. The residents are furious that they are being "raped" for the last 6 years and nothing is changing. Mr. Pineda, I think this is a worthwhile story for your newspaper, since this is mostly foreign investors coming to the Dominican Republic to retire and live a stress free life and ending up in turmoil. I would like to meet with you in Costa Bavaro and have you listen to many of the residents and even speak to the administration here for a story in the Dominican Today. Look forward in talking to you.”

Another investor:

“I am writing to denounce the abuse to hundreds of investors on the part of the real estate company Intercaribe, S.A. Ironically the same day (October 9 ) while the president (Leonel Fernandez) inaugurated a project symbolizing the country’s progress, Intercaribe S.A., represented by Mrs. Ilonka Castillo as its president, misappropriated with hundreds of thousands of dollars.”

“Numerous sums of dollars, which honest middle-class investors, most of them with intentions to retire in R.D., were deposited in the hands of Mrs. Ilonka Castillo and company.”

“Mr. Pineda, for your information and to superficially understand the importance of such a significant situation, Mrs. Ilonka Castillo is the same person who represents the Dominican Republic internationally in her role as president before (FIABCI), the International Real Estate Federation.”

“The abuses to the people who have invested in Costa Bavaro continue still, Mrs. Ilonka Castillo has yet to respond for the money she received and a significant number of investors are taking Mrs. Castillo to court by means of their lawyers.”

“The Progreso Bank itself has foreclosed on the properties that Mrs. Castillo failed to pay for, although she received the money from the owners who were swindled, the bank took possession of the properties valued at $20 million dollars…the events at the IFA’s Residencial Costa Bavaro are of extreme importance for the country and its progress. The valuable information which we have will be news that will have repercussions in other media.”

After this is the Domincan Republic where these crimes go with impunity. Not that this dosen't happen in other parts of the world. Rember the Domincan Mentality is to screw everyone and run.

Yes some get caught however they will be relatives of some ah in power and gone is your money. This is the Domincan way of doing business.

This sounds like it could have happened anywhere in the USA too, because it happens where ever there are STUPID PEOPLE who trust scammers because they are too cheap to do a proper due diligence, check references, search court records, hire an attorney and hold funds in escrow. I don't feel sorry for these fools because they asked for it by tempting this woman with tons of money rather than take the necessary precautions in the Banana Republic of the DR. They now get what the deserve and they are not alone. There are literally thousands of bedazzled victims that are sought in foreign shows to put their money down on these paradise dreams all over the world. What about Punta Perla? How many victims are there? There will always be scammers in real estate because a sucker is born every minute and especially in latin areas like NY and Miami. Those are the happy hunting grounds for trolling for suckers.

interesting spin, synapse. it is the fault of the victims that they got robbed. in the mindset in which some of us live, the fault lies with the criminal element, which seeks to victimise anyone they can. in your moral universe, the victims deserved it. well, there are some people who operate with the kind of moral dynamics that cause them to be trusting of others. they do not live in worlds where everyone seeks to screw everyone else. therefore, they do not consider every action they undertake to be a potential disaster, because they do not defraud others. besides, they have probably done business in honest ecosystems before, and so their guards are not razor sharp. sadly, they were unaware that in the DR, honest people are not exactly coming out of the woodwork these days.

Very often in these situations, people do things they wouldn't think of doing in their home country.

Buying and paying without a title, not requesting funds be placed in escrow, paying full price in advance for a house not even built, etc. etc. etc.

If you're not a sucker in your home country, what makes you become one here?

let the buyer beware ...I can not believe that people can be so gullible as to hand their money over to a real estate agent whom they have met only for minutes or hours and I also have limited sympathy for these people. The standard practice in the DR ,as it is in every country that I know of,is to engage a lawyer or a solicitor to do all the searches and sometimes while this is occurring you place a 10% deposit into a trust account that can not be touched by the vendor .When all the searches are done and the lawyers are happy the vendors and buyers sit around the table and they do an exchange of documents and money .
I have bought and sold quite a few times here in the DR and the only problem that I have had is with the slowness of the transfer of the title .
There is a problem with titles in the DR on land that has been subdivided and it is crazy for anyone to part with money before titles have been sighted and as for building on land that you do not own ,,that is worse

What is the undoing of the DR is NO ONE does an f...en thing about putting these people in jail. It is acceptable behavior.

Hell, in the US they want 1Billion $ from the owners of the Mets baseball team for the Bernie Madoff fiasco. The government is saying that they had to know something was wrong, they can't be that stupid.

Funny with all this buyer beware nonsense. In a country with laws which are actually enforced this woman would already have all her assets frozen and a warrant would be out for her arrest. Other entities involved with control of property in countries with a true legal system do not allow real estate fraud of this magnitude to take place.

Even if she is caught those persons thought to have more money will be extorted to bring about any type of justice.

The rule when buying real estate in the DR is extremely simple. Don't buy anything just rent.

For the most part the only people buying and building are criminals hiding their money. Anyone with a brain knows your property title can be a forgery here or can change hands if someone pays the correct bribe money.

These people got scammed is the bottom line. Nothing more will ever happen and if they put any more money or effort into getting justice they might as well just set their money on fire and watch it burn.

I agree with you Veronica. The authorities should seize her assets and issue a worldwide warrant. Why was this not a problem during the 80's when I bought land here? It was only in the late 90's that I started hearing about these scams.

I think that Veronica needs to do some research before she writes such idiotic things ..the problems with titles are nearly always with those who donot make the correct searches and the rule she gives of just renting here instead of buying is simply ludicrous ,,,there are millions of people here who have very successfully purchased property here ,

this is not true.i have 3 homes i own, my family has 6 others which they rent out. when u buy in the states u receive the tittle papers at the closing. most closings both side have lawyers with them to go ove r the paper work, if a bank is envolved then some one from the bank is also prssent at the closing.
if for any reason some-thing does go wrong you get title insurance before u can close. on any deal..any home, apt, condo, any real estate is registered with the local country clerks office and this information is made aviable to the public to view.

in the 70's it was bringing in stolen cars from new york city, in the 90's and up today the biggest business in the dr is real estate fraud. could be wrong it might be the drug trade that is the biggest business in the dr. for sure its not the banana business.

the country makes more money the people get work, more money comes into the country if outsiders invest into the dr.

is funny how My comment gets ranked negative for telling the truth by experience. Maybe those ranking it negative can provide a credible argument instead. It is a fact that the Dominican Government and its people dont do all they can to protect the tourist and the investor.

You are correct in what you point out but you are extremely wrong to believe that there isn't a personal responsibility to dot the i and cross the t when you are buying anything of substantial value.
These people were swindled because they failed to exercise caution. In the good ole USA both Real Estate Brokers and Mortgage Brokers go to jail everyday for scamming good naive people. As a Broker I get a list monthly! Evidenced by the torrent of foreclosures from sub-prime loans that were mostly given to people who could barely read, we have all witnessed the legal scamming of millions of people in America. How many people do you think are going to go to jail for that? Unfortunately not enough. They got scammed just like this bunch got it in the DR and would've gotten it just as bad in the USA and perfectly legal if their eyes where so wide shut.
It is a Buyer Beware world and I don't have any sympathy for those who sleep walk through life.

I have written many articles about the feeding frenzy that perpetuated the real estate boom of the last decade in the DR. Seventy percent of it was Dominican Investors who where hood winked by friends and sales people into investing in property under total illusion conditions. Dominicans had never witnessed property actually going down in value, so they jumped in head first. They led the foreigners to jump in after them, also without looking at the risks below. It was a feverish hype perpetrated in a conspiracy between Brokers and Developers using advertising methods that are totally legal. This was a carbon copy of the what was happening in the USA and just duplicated in the DR. Now if you are wondering what property is really worth in the USA or DR, it is only really worth what someone is willing to pay for "personal USE" purposes and no more speculative value. We are back to the real world of values without the inflated hype and you should be seeing it bottom out soon.

These culprits only hurt your business and your opportunities. So, why are you guys so hard on the victims? Is the practice of scamming acceptable to you that you are so nonchalant to it?
We all know that finding an honest anything in DR is like "looking for a needle in a hay stack".
So when someone as educated and presentable as "Ilonka Castillo" is out there making false promises to investors in the real estate market you should be more concerned that these people are stopped rather than beating and insulting these innocent victims.

My life is in total ruin because of the Castillo’s and their lies. Twenty five years of savings, over $1,000,000 dollars in loans, successful real estate practice and my marriage has crumbled over the misappropriation of funds by InterCaribe, the Castillo’s and now IFA resorts. The amount of stories I have been personally involved with are heart breaking. I came to Costa Bavaro in 2004 and built my first 6 apts, and was approached by Mr. Castillo several times to partner with him. Noticing that he was not partner material, I continued investing in land and building in Costa Bavaro. My second construction was 28 apartments in the second phase. I chose that location because of Frank and Illokas promises to build a club house, and a majestic entrance to Costa Bavaro in the second phase along the new highway. . They managed to swindle millions of dollars from Washington Heights investors and never deliver Villas del Sol 2 and Villas de Sol 3.

It is very clear that the phase 2 has been forgotten. InterCaribe and Illoka Castillo believes that the residents of Costa Bavaro will go away by handing over the responsibilities to IFA, a major Bavaro Punta Cana all inclusive resort. This will not happen. There are hundreds of investors, owners and tenants that are being abused and swindled out of their hard earned money and we will not laid down and continue to be taken advantage of . The hotel has too much to lose.

. Villas del Sol have even more problems, they lost investments and have no titles. Today those projects lie abandoned and millions of dollars left our complex, when promised to be used in the construction with legal and binding contracts. Individuals that lost their monies exist and the contracts exits. The list of broken promises that stem just from those lies has affect millions of dollars including a shopping center and 5 or 6 other projects induced by the Castillos. Because of this the economic flow drastically changed the face of Costa Bavaro. A project that was the central and show piece of Bavaro stopped.

. The hotel collects in the same amounts and percentages in both phase therefore both phase should be treated the same. I am part of a large group that has gotten together in the past to calmly speak and resolve this matter. The IFA hotel a year ago assured us that this would improve, only again to work in their self interest and join the Castillos in drastic lies. It is now time for the group again to do what is should in the first place. There is sufficient evidence and plenty of angry investors. It would a shame that this news got further into the world with more stories and proof of the Castillos misappropriations of funds and IFA’s continuance of the crime.

Let’s keep it simple and only talk about IFA resort, InterCaribe, Frank and IIloka Castillo. IFA resorts bought and inherited the problem from the Castillos but buying they are fully responsible because they receive and distribute all the outrageous maintenance fees from all the homes and apts in Costa Bavaro. Since we all in life with our self interest in mind, IFA only attended to their visual entrance to the hotel. This is why they only take care of the first phase. The hotel guests never see the second phase.

To whoever will read this email today. I have a list of owners of Costa Bavaro. I am witness to many things and am willing to help in every way to correct the injustice that continues. I am not afraid. I call all the others, that are afraid individually, so we can unite. United we will have the attention of even the president. United we can bring Costa Bavaro back. United we will do the right thing and salvage some of our dignity that was taken away.
