Santo Domingo. - Central Electoral Board judge Eddy Olivares on Sunday said the children born in the country, of Haitian laborers, have the right to a Dominican identity.
He said the electoral court doesn’t have the jurisdiction to cancel the cedula (identity card) of the Haitians born in the country, even if their parents haven’t had the category of Dominican citizen or resident.
The official noted that the parents of most of the Haitians born in the Dominican Republic, and who are of legal age, came to the country as laborers via agreements between the governments.
Interviewed by Héctor Herrera on Telesistema channel 11, Olivares criticized that the Board assumes a role he affirms isn’t its jurisdiction, adding that the country’s migratory policy has its responsible institutions, which in the Dominican case is the Immigration Agency.

Mr. Olivares is wrong on every aspect of his opinion.
1st. JCE has NO jurisdiction to issue any cedulas unless proper paper is in place.
2nd cedulas can only be optained by providing a birth certificate or legal status papers
If JCE was to issue anything based on Mr.Olivares opinion then it actually be stepping way of jurisdiction and above the constitution. a work permit for season workers is NOT A birth certicate.

I definitely agree with you, giving these kids the Dominican nationality would be asking for people to cross the border illegally. @jimmyharrington, you are right, I mean, if the kid if born in the DR, its only right that he is given his Dominican nationality, that'd the way it is everywhere in the world, but we as Dominicans have to think what's better for us and our country, they'd no other way.haitians cross the border no matter what, providing their kids with the citizenship only means more trouble for us, we have to deal with the illegal immigrants. Only God knows I am all for legal immigration, you just need to follow the rules and everything will be okay. Your idea makes no sense, people among the agex of 16 and 60 arenthe actual working force that immigrates illegally. That's the core of the problem, my friend. Kids younger than 16 are in the DR because their parents, who probably are younger than 60 and older than 16 brought them here (by probaby I mean, most likely than not). People 60 and over have been illegal immigrants for a long time. If you look at the Haitians here, the majority are probably in the late 20s, 30 or 50. They bring the younf illegals, they are the ones that need to be controlled, if you want to controlled the other age groups. Maybe thats why Balaguer's idea didnt work the first time, it was really bad. We still have the issue, worse than ever even. Sorry, I dont like Balaguer, and I think he was one of the worse presidents we had up there with Hipolito and Leonel.

1st. JCE has NO jurisdiction to issue any cedulas unless proper paper is in place.
2nd cedulas can only be optained by providing a birth certificate or legal status papers
If JCE was to issue anything based on Mr.Olivares opinion then it actually be stepping way of jurisdiction and above the constitution. a work permit for season workers is NOT A birth certicate.

I definitely agree with you, giving these kids the Dominican nationality would be asking for people to cross the border illegally. @jimmyharrington, you are right, I mean, if the kid if born in the DR, its only right that he is given his Dominican nationality, that'd the way it is everywhere in the world, but we as Dominicans have to think what's better for us and our country, they'd no other way.haitians cross the border no matter what, providing their kids with the citizenship only means more trouble for us, we have to deal with the illegal immigrants. I thought that according to the Haitian constitution, any children of a haitian born abroad was still Haitian. So according to your own constitution this is not possible.

Wrong.................The US is one of a few, handfull of places that grants citizenship to children of illegals. It is not like that in most places around he world. Just to give you a few examples: Switzerland, Germany, Austria, Japan and many others do not.
Why do foreigners want to force us to grant Dominican nationality to the children of illegals is beyond me.
