Santo Domingo.– Police agents on Friday arrested a 52-year-old agronomist in Neyba, against whom it was issued an arrest warrant for allegedly raping a 11-year-old girl.

Jose Antonio Mendez Montero (Jose Milena), who is the chief of the Codo-Cafe Office, located on Las Marias Street, number 43, in southwest town Neyba, is accused of raping his niece, 11.

The indictment against Jose Milena was filed by relatives of the child. According to the medical certificate, the girl had "hymen defloration."

What ever happened to the presumption of innocence?
Given the lynch-mob mentality of this country, is a miscarriage of justice to publish the details of the accused before anything is proven in court. Even if proven totally innocent, he will carry the stigma for a long time.

Roy ..I do not know why you think that th english legal system is in place here ,,the system is different and the major part of english justice,which is the prosecution must prove a case against the accused is not a reality here ,,here the defence lawyers may be even doing deals with the prosecution ,,,But even if the new Dominican constitution says that a man is innocent until proved guilty , the reality is very different ..
even precedence is virtually unknown here and cases are judged on a cas by case basis ..By far the bigeest diffreence is that there is no jury here ..so the judge decides if the testing of the evidence by the defence is sufficient to warrent an aquittal

Ricky, it is true the prosecution must prove guilt " beyond reasonable doubt" in normal criminal cases. However in civil cases, it need only be proven "on the balance of probabilities" and in family law, "the best interests of the child" prevail on the opinion of the judge, regardless of evidence, and in some rape cases, guilt is assumed. There have been cases where guys have done time, only to be release years later when the woman admits she made it all up. In rape cases, hearsay rues no-longer apply and the accused is denied the right to cross-examine the accuser if he is a self-represented litigant.
