CHARGES OF FORGERY, NOT SLANDER

Santiago.- As announced Monday the First Lady Margarita Cedeño, represented by the lawyer Luis Miguel Pereira, today filed document forgery charges against TV journalist Marcos Martinez, who had accused her of having an account of 73 million euros in a Danish bank two weeks ago.

Cedeno asks the court to convict Martinez and to pay RD$10 million in damages, which would be donated to hospitals in Santiago.

Pereira, who filed the charges in the Santiago Office of the Prosecutor, said the proceeding doesn’t seek money, but to defend the First Lady’s honor and moral instead, adding that Martinez made the slanderous statements without any proof.

Upon receiving the complaint, Santiago prosecutor Luisa Liranzo said the documents will be immediately evaluated to start the investigation, prior to sending the case to the Santiago Judicial District’s Penal Chamber.

What a crazy legal system.
In normal countries, forgery is a criminal offense, not a civil tort. This would normally be a civil defamation case. I would dare to say that in this country, more documents are forged or obtained by deceit, or graft, than are genuine.
Anyone like to challenge me on that?

Regardless this may be an interesting case if contested. RD$10 million in damages is chicken-feed. The costs to initiate and defend such as case would be much higher. I think he'll settle out-of-court to avoid a much higher defense cost, and she gets to save face and not risk whatever may come out in a court case. Perhaps she will provide the RD$10 million under the table from her departmental budget anyway. Hmmm....

I do not see much problem with the legal system, but with that First Lady and her lawyer.
In a middle of an election campaign one does not need publicity of this sort.
Who cares if that reporter had, or not, documents to prove millions on some Danish account.
First Lady was not sued for tax evasion, so she does not have to prove anything, or respond to.
It looks like a long way to "real" democracy" in DR.
These games are well played in Canada, and USofA, to nobodies surprise.

"The Secretary of the ruling Dominican Liberation Party (PLD) said that "two of his companies" won two of seven international competitions in which he participated to implement projects of construction and reconstruction in Haiti."

Still in a normal country, there would be no case to sue for forgery. The document(s), if forged, were not used to gain economic advantage. If they were it would constitute fraud. If they were used to defame the person, as is alleged, then there may be a case for defamation. However the plaintiff would have to prove a real or material loss as a result of the defamation. For example, if she failed in the election as a result, then loss of income would be a legitimate claim. However it would be impossible to prove that she would have won, had she not been defamed. Case struck out. Plaintiff to pay costs.

I think she has a very legitimate case of defamation. The guy used his media outlet and the various media outlets available to make his allegations. And given that these allegations were made in the heat of the campaign for Presidency, I have a hard time thinking this was just an insignificant gambit. If Martinez is so stupid to have played the stooge let him pay the price. And what if in the investigation and judgment its determined that a cushy job was dangled before the besotted Martinez?

When and where did he gain access to the forgeries? Did he have a partner? Were these forgeries given to him by someone in the opposition party?

Just some of the questions a jury might flush out answers to.

I cannot vouch for Dominican law as it has me totally stumped.
However in normal countries, intent is a major factor. If he can show he had reason to believe the information was correct, and published it in the public interest then he would have a strong defense. It may be argued he did not make sufficient steps to ensure the information was accurate. However a journalist is not required to determine beyond doubt that is is true. He could claim that he too was an innocent victim of deception.

I suspect he was set-up by the PLD, in an attempt to discredit the PRD and to make Margarita look good, and so far it has worked, despite the phony black-placard brigade demonstration, and the PLD using a public monument as a bill-board stand.

In dollars that's approximately $264,000.00. In the DR you can get a defense for much less than that.
