Santo Domingo.- The 2009 arrest and conviction of members of a gang which swindled the ball player Julio Lugo with a RD$50.0 million land deal in an upscale sector of the capital with forged titles, have led to the dismantling of other rings, some of which even include lawyers, notaries and former Real Estate Court employees.

The frauds have led not only to indictments but also the suspension of judges, disbarment of lawyers and notaries, and employees fired. And despite the dismantling of the networks and stricter controls have led to fewer cases of fraud, they are still a problem.

Ten investigations are being conducted by the Government Attorney's Office on counterfeit titles to properties in the National District and La Altagracia, Santo Domingo and San José de Ocoa provinces.

If the evidence merits criminal prosecution, said Government lawyer Fermín Casilla, the case is submitted to a court, if not, the file is archived and the decision is communicated to the Title Registry Dept.

Casilla affirms that while the forgeries have lowered by as much as 90 percent, 10 cases have been prosecuted in 2012, and 20 in 2011. "There’s more legal security now. People who have a real estate property can rest easy."

Quoted by listin.com.do, the official said entire rings of counterfeiters have been dismantled with most of its members arrested, citing the ring of title forgers in Higuey (east), and the swindler convicted in Lugo’s case, Edwin Baquero, ex leader of another ring.

I wonder if that second rate educated Dominican lawyer Arturo Feliz has been implicated in this conspiracy. I hope so, he travels alot to Puerto Rico and Miami, perhaps if we can link some of this activity to the U.S., mybe we can get these guys on Federal charges here in the States. i hope so.

Excellent news.

Now implement and enforce the laws against these thieves that cause so much problems for Dominicans and foreigners alike. Having a well functioning Title Registry administration is crucial to promote sound investments and decrease litigation in the courts. Have I mentioned, And would do wonders for the enactment of taxes on property?

Ok so one racket down by 90%, that's an improvement, but the Gov has to go after hundreds of more rackets that regional local mafias control in this Banana Republic.

There is a lot of work still to be done and you can expect a lot of resistance because politicians and mafias control a lot of the investigating authorities too.

what about people who owns land and dont have the title. like andres boccachica is one area that 90% of the people dont have title to the land but have have home and been living there for years how do they register there land

Old time squatters are a very BIG problem in many Latin American nations. Since the State has traditionally been small and inefficient in many matters, regional and sub-regional practices such as taking over a patch of land and claiming the property as theirs has had a long and troubling tradition in many countries. DR is no exception. Many economist understand that removing the impediments to ownership is necessary as it is a leading cause of non-formalization of the economy. Thus the Black Market gains from having all these Title-less property owners, as these owners are largely shut off from legal transactions in loans and financing. So DR has to address this difficult issue head on and where it's possible to extend ownership based on long term residency do so, and where it's problematic-say in sensitive bio-diversity areas, move out the swatters, as in Los Haitises National Park.

Making long term squatters real property owners will then provide a measure of safety and the now titled owners will be able to have access to legal loans and financing. The nations also gains by having these swatters legalized as it will now be able to charge them for municipal services and upgrades. So time for DR to remove these impediments to progress.

Of course, there are so many people living in illegal shanty communities along river banks and the like that implementing this program on a massive scale will need some form of outside assistance. But if so then the State and Nation must adhere to the new modality and truly shift course as this title-less system causes so many externality costs to society.
