Santo Domingo.- A substitute judge is once again at the center of scandal, as the National District 6th Instruction Court yesterday ruled to release five defendants accused of being part of a ring of counterfeiters of deeds of property including military assigned to the Real Estate Jurisdiction and employees.

Judge Vladimir Rosario Garcia ordered the immediate release of Francisco Antonio Medina, Angela Mundaray, Oliver Manuel Fiallo, Carlos Manuel Vasquez and Edwin Omar Sanchez, after calling the group’s prosecution inadmissible.

The judge ordered a halt to any restrictive actions and the return of properties seized during the investigation, and sent four to stand trial.

Edwin Baquero, Ricardo Mota, Henry Melenciano, Walter Lendor and Geovanny Santana will face criminal proceedings with 50 pieces of evidence submitted against them, among document and testimonies. Of the group of 10 one was released on one million peso bond.

The Prosecution called the group part of a ring which forged deeds of property titles and former District Attorney Alejandro Moscoso and former National titles registrar Wilson Gomez revealed that Lendor was an employee of the Property Jurisdiction and Santana, an auditor in the Supreme Court, who’ve been fired for providing logistical support to the counterfeiters who then swindled several people our of tens of millions of pesos.

According to the indictments, the ring forged the signatures of notaries and pilfered documents and public information, with the help of judiciary officials.

The forged documents include those from the National Property Administration (BN), National Housing Bank (BNV), Internal Taxes (DGII) and Presidential decrees.

I happen to know some of the 4 persons that will be prosecuted, and they are pretty heavy hitters, some considered as players, and in the DR elite, and the mere fact that they will be stand trial, and are in jail, is a big step forward.

These substitute judges or interim judges should not be assigned high profile cases. The fact that they do demonstrates that the tenured judges don't have the balls to hear these cases for fear of repercussions or conversely, they don't want to hear these cases because they are linked with the perpetrators in one form or another.

In any case, the justice system here is a joke, a bad joke.

No it is not corruption ,,,it is the total inefficiency of the oficina de fiscal the prosecutors office ..if there is no proper evidence provivided or submitted to the court how can a judge imprison people ...that would be corruption and dreadful legal justice.

No I am certain the problem was that the prosecution failed yet again to present a case ..at present I am involved in several cases where much the same is occurring and a man who was originally given the 3 mandatory months has been in prison for more than 12 months and there is not a shred more evidence provided by the prosecution than there was a year ago ..so you would think the prisoner should be released .No he is languishing in prison .

These "substitute judges" are backroom judges. (scrape goats) that's why they are place on the chamber in the first place. When high profile cases with heavy hitters comes along, it is released to these UN-ethical, unscrupulous, immoral assigned want-a-be judges...

Same with ALL political parties!! Purple, White,Red, Green, Yellow etc....

I am sure he was not paid off but that the case was not properly prepared ..that is sooften the problem here , The system needs to be totally dismantled and the office of the fiscal needs to be overhauled so we havein this country the very simple principle that a person comes to a court innocent , that the prosecution must produce evidence against the person and the defending lawyers must test the validity of the evidence .If the evidence is false , then the person is released .Just normal justice .
And if people fear a judge has been paid off , they can have the right to be heard by a panel of 3 judges /

really!!! its not a stupid statement its a comment with a lot of history behind it, i also would not keep two cents in any bank or buy any form of real estate in the dr.
as i write many times on this site and i have been on this site going on 5 years
in the early 70's bring cars u robbed in new york city back to the dr was the number one business in the dr then the dr went into real estate fraud and now its the drug business, but the good news is that all of the 3 above business's are still doing well in the dr

where do u think the money came from?
they have not one invention to their credit.
they may tell u they invented the internet, i-phone, computers, and even face book,
yes they would like to dream as they screw u out of your money.
u will see many fancy cars and men in expensive suits but dont think they are some one special in most cases most of them dont have a 3rd grade education and are crooks most either have a good job with the government or sell drugs or what ever they need to do to make this money.

The property title situation in DR is well known to be unreliable at best and corruption by public officials is evident in many cases. The Rincon Beach in Samana is alleged to be own by over 100 families and they have fought for years regarding the title to the beautiful beach without much results. Just an example of the mess the land title is . Once I asked about title insurance while purchasing a property and they look at me like I was crazy.

Although Stuart Title does insure title there is very selective and expensive
