Santo Domingo.- The government of the Dominican Republic on Wednesday issued a temporary residency permit to Juliana Dequis Pierre, whose parents are undocumented Haitians, as the first step within the nationwide plan to regularize foreigners living in the country illegally.

The measure stems from the ruling which has fueled protests in Miami, Port-au-Prince and San Juan, while in Mexico, the Inter-American Court of Human Rights hears testimony from alleged Dominicans who say they were expelled because of their Haitian origin.

Immigration Agency director José R. Taveras made the announcement, and noted that the measure complies with paragraph four of the Constitutional Court ruling of two weeks ago, which has since unleashed fallout locally and abroad, by groups which rebuke it as racist.

The official said all branches of government must comply with ruling TC/0168-13. "The ruling handed down by the Constitutional Court is binding on the three branches of government and obviously we had to comply within the 10 day period and that’s what we have done."

Quoted by diariolibre.com, Taveras said Immigration registered Dequis Pierre and will do so with all persons in a similar situation, as the ruling orders, and will be issued a temporary permit until the policy of the plan to regularize foreigners is enacted.

On the referred Plan, he explained that we should expect that the Minister of Interior and police, José Ramón Fadul, who presides over the national migration Council, convened for this purpose, because the statement has a mandate of 90 days, so that the Agency render a report.

The official said the measure from the ruling is the beginning of the end of the "human drama that impacts all concerned."

The Constitutional Court ruling orders Immigration to issue to Deguis Pierre, a descendant of Haitians, a "special temporary residency permit in the country" after she requested a protection order while she appeal on the sentence.

No problem guy..... But I have one question for u, she looks much older then her 14 years?.... Lol have a great day in Santo Domingo with the other Haitians ....I would tell u that u should get some lunch at the plaza blue mall or Acropolis but it seems most of the shops in their food courts are out of business. How if these shop owners would have sold Haitian Mud Pies and Dominican Caca Salami they would still be in business.... Need to run over to my bank and make a deposit (big Deposit)... Had some really good days with my business in the Florida Keys..( and we don't sell the salami or the mud pies).... Of course it has to do with immigrations laws. What is going on is an attempt to delegitimize the laws and constitution of DR by claiming racial discrimination and using irresponsibly hyperbole like "apartheid" because some don't like our exceptions to our "Jus Soli" laws.The exception has been around since around 1929. Again, this is not about the few that may, or may not, have a legitimate claim, but what it represents to future illegal migration of Haitians.

Love the Miccosukee Indians and the Seminole Tribe both have very large Casinos in Florida make millions a day off the "White Eyes" the Seminole Tribe has the Hard Rock hotel and Casino iin Tampa and Hollywood Fl... Dominican Republic Court Ruling Raises Mass Statelessness Threat

October 2, 2013


The Open Society Justice Initiative is urging the government of the Dominican Republic to ensure that none of its citizens is rendered stateless, following a legally-flawed constitutional court ruling that envisages the denationalization of hundred of thousands of Dominicans of Haitian descent.

The 11-2 decision of the constitutional court, dated  September 23, found that the provision on citizenship in the 1929 Dominican constitution, which recognizes as a citizen anyone born in the country, should not apply to the children of parents who were not “legal residents” at the time of their birth, on the basis that their parents were “in transit”.

It further ruled that as a result these children, and subsequent generations born on Dominican soil, are excluded from the citizenship guarantee provided by the constitution.

The order effectively strips citizenship rights from the descendants of Haitian migrants settled in the Dominican Republic since the start of the 20th century, despite the fact that the current constitution declares as Dominican anyone who enjoyed Dominican citizenship prior to 2010.

The vast majority of these individuals will be left stateless.“We are deeply troubled by this ruling,” said James A. Goldston, executive director of the Open Society Justice Initiative.

“It threatens a massive denationalization that will have a potentially devastating impact on hundreds of thousands of Dominican citizens. It risks rendering tens of thousands of people stateless, and excluding them from basic state services including access to health care and education.”

The Justice Initiative notes that the UN High Commissioner for Human Rights has called on the government“to take all necessary measures to ensure that Dominican citizens of Haitian origin are not deprived of their right to nationality in accordance with the country’s international human rights obligations.”

Goldston noted that the order also involved retroactive application of the law which is impermissible under both Dominican and international law.

The order  directly contravenes a 2005 judgement of the Inter-American Court of Human Rights. Its decision  in the Yean and Bosico v. Dominican Republic case, ruled that the migratory status of the parents can never constitute justification for the deprivation of nationality and that children cannot inherit the migratory status of their parents.

The court observed that “to consider that a person is in transit, irrespective of the classification used, the State must respect a reasonable temporal limit and understand that a foreigner who develops connections in a State cannot be equated to a person in transit.”

The constitutional court, in direct contravention to the Inter-American Court’s ruling, not only conflates the concept of in transit with that of non-residency but also orders the application of such a requirement to be applied retroactively for over 80 years.

The ruling also orders a highly disturbing procedure for its implementation that would constitute a breach of international prohibitions against racial and ethnic discrimination.

It proposes the identification and listing of all citizens of ‘foreign origin’ from the Dominican Civil Registry and the creation of a second list for those who under the new criteria given by the court are considered to be mistakenly registered as Dominicans.

The names of people listed in this new regime will then be administratively transferred to foreigners’ books and notified to the foreign ministry so that the ministry informs the affected individuals and the supposed correspondent embassy.

The Justice Initiative notes that state sovereignty over nationality is most clearly restrained by the prohibition against racial and ethnic discrimination and this principle is integral to all international and regional human rights instruments.

In addition, the procedures ordered in the constitutional court’s ruling clearly violate the Dominican Republic’s obligations of well-established human rights principles, particularly the universal anti-discrimination norm.


The Justice Initiative further expresses concern that the judgment employs a definition of citizenship that is impermissibly discriminatory, referencing racial and linguistics features in demarcating citizenship.  

The Dominican Republic is a state party to the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD) and as such it has human rights obligations to ensure equal protection before the law in the granting of nationality.

More broadly it must eliminate racial discrimination in all its forms and manifestations.

Otherwise, we knew it all the time, it is because they are black.
Yes, they cross the border because they are black.
Yes, they cut sugar cane because they are black.
Yes, they get deported because they are black
Yes, they are illegal and undocumented because they are black.
Yes, they work construction and farm labor because they are black.

Now there is one part I don't quite get, are they Haitian because they are black or are they black because they are Haitian? Which came first the Haitian or the egg. Now was that a white egg or a brown egg?

And finally, why is it that the DR gives preferential treatment to all of White Haitians that cross the border in massive numbers. Now why is that?

Again, the narrative that is being created is that deportations of illegal Haitian immigrants are illegal because they are based on their skin color, and nothing to do with their immigration status, using as a supporting evidence that the majority of Haitian deported were black.

The other narrative tries to invalidate the exception to the "Jus Soli" law, alleging racial discrimination, eventhough no evidence that light skin or white Haitian are consistently being exempt from the law.

He actually had the audacity to go to the international courts and file a lawsuit. He should be arrested and sentenced for fraud and for a frivolous lawsuit......I am telling you these people are something else. I always wondered why so many of these Haitian nationals have Spanish surnames and now we know why.

Christian Aid; Born in Dominican Republic but of Haitian descent, Milciades Yam (43), has struggled for many years to get full recognition as a Dominican citizen. In Dominican Republic you need a copy of your birth certificate each time you get a new job, or renew your ID card, and Milciades has lost count of the number of times he has applied for a new copy.

Imagine being born in a country where your parents and grandparents also grew up and then one day being told you are no longer eligible for nationality there. This means you will no longer have access to education, healthcare, a formal job, social security, or even be able to marry or register the births of your children.

Dominicans Protest Move to Revoke Haitians of Citizenship

Community leaders in Washington Heights condemned a decision by the Dominican Republic’s Supreme Court, which would strip citizenship from thousands of children of Haitian immigrants born in the Dominican Republic.

“It’s disgraceful, ridiculous, and highly discriminatory,” said activist Miriam Mejía of Casa Verde Camila in a speech, expressing the opinion of a coalition of organizations.

UNITED NATIONS (CMC) – The United Nations Children’s Fund (UNICEF) has warned that a ruling by the Constitutional Court in the Dominican Republic depriving Dominican-born persons of Haitian descent of their right to citizenship could have a “devastating impact” on thousands of children.

“Without a nationality, stateless children can be denied access to basic social protection programmes, cannot earn education certificates or graduate, or obtain an identity card or a passport,” said UNICEF in a statement on Wednesday.

Just came back after spending lunch with a friend a few minutes ago. She had returned from a cruise last week and she wanted to tell me all about it. One of the ports of call was La Romana. My friend has never been to the DR, it was the first time stepping foot on Dominican soil.

The ship docked at 10:00 AM and left at 2:00 in the afternoon, a total of only four hours. Do you know what were the first words out of her mouth, alarmed and surprised, "Wow, pero que mucho Haitiano, bendito" and she was there only half a day. She would have been even more surprised, had she spent more time and traveled all over the country, surely she would have been shocked.

Yes it is...........her marido was an undocumented Dominican and shortly after they got married to help him get a green card, the man pass away all this while she was pregnant with their second child. She was never able to develop any ties with the family back in the DR, meanwhile another man can into her life and that was pretty much the end of that. She is currently married with a guy from Peru who also accompanied her on the cruise.

Lawyer Carlos Balcacer has called for an agreement between the Dominican and Haitian states. He said international organizations should help Haiti document its nationals. He said Haiti "has always been a factory of undocumented human beings," as reported in El Caribe. "Haiti is a country that does not let others help it, there has been no way for Haiti to organize the civil status of its nationals, most Haitians do not have birth certificates because Haiti does not issue birth certificates," he said. He said that this situation creates serious problems.

Diablo tupa! nice to hear from you... I understand your president his Excellency Lionel have significantly increase the foreign debt from 8 billion US to 12 billion. Dready & Josean predicted such scenarios way back if my memory is correct obviously printing more money was not the options, however in the positive side, they are not defaulting and the bulk of the money was spent in infrastructure projects, which are perhaps too early to accurately quantify any direct economic benefits. Mr Lionel legacy is undeniably assured.
