Santo Domingo. - The National District court that hears the case of Miguel Familia versus the U.S. Embassy on Monday ruled to continue the proceeding in the same tribunal, rejecting the plaintiff’s challenge recusing 3rd Civil Chamber judge Yokaury Morales.

The ruling was issued in a statement by the Appellate Court’s 2nd Civil Chamber which hears the lawsuit against the U.S. Embassy for an alleged error in a DNA test which Familia claims ruined his family life. "This court has been able to determine that there are no causes or valid reasons in fact and law which may allow the challenge to proceed."

The plaintiff claims that on October 11 last year judge Morales, in a “cocky and arrogant and threatening tone” told Mr Familia that if he continued with the case "in the media" he would lose because "she would rule against him."

Evidence of how Banana Republic attorney's use intimidation and coercion to suck settlements by bringing nuisance suits to the courts until settled. Legal Extortion is a thriving industry inn the DR by the thousands of lawyers that have no way of making an honest living. I am sure this lawyer pays this guy a stipend to continue to protest and bring media attention to his stupid claim. He deserves it for not believing his wife, of course who would believe a gold digging Dominican woman in the first place.

He should file suit in US courts. But unless he has deep pockets, I doubt if it would be worth while fighting. I think if worse comes to worse, they will settle out of court for minimal compensation perhaps a consolation prize for the inconvenience, an inflatable doll he can plug in to a wall socket. She will be true and loyal to him for the rest of his life and will never ever have a doubt on his mind.
