Santo Domingo.- The Customs Agency on Monday affirmed that Barrick Gold Corp. faces a fine as high as US$23.2 millon for errors found in the shipping manifest for the gold and silver ore called doré, or twice as much as the cargo’s worth.

“In principle there was a mistake in the registry of origin, from there we will determine if there was another error,” Customs said in relation to Barrick Gold’s description that the doré was from the U.S.

It said the penalty is double the value of the merchandise declared.

Although gold mining exports say the total value of the eight crates inspected was of US$17.0 million, but Customs deputy director Gregorio Lora didn’t confirm or deny the figure.

He said the Customs Law will be “strictly enforced.”

The good thing about this is that if Barrick committed the same error in the last 19 shipments they can also be fine because the Dominican customs laws states that customs has up to 6 years to go back and re check all shipments and if an error is found they can fine the person or company that did it. This I know because I used cleared gold and silver packages for free zone company and also went to a couple of seminars about customs forms and declarations.

More sable rattling by the customs officials, and I just heard that a fine for US$23 million was levied.
Danilo has to walk the talk now, since Barrick refuses to yield, (even though they did sit down last weekend with no results) and issue the executive order taxing all gold and silver shipments.

the LIFE of these people can be made VERY VERY DIFFICULT just by the simple act of ENFORCING THE LAW, Barrick gold can't say NOTHING regarding to a fine like this becasue is called CONTRABAND and as such is a criminal act, there MANY more WAYS on which just by enforcing the LAW barrick gold's life can be truned to MISERABLE, such as enviromental regulations, labor Law, Tax Law, etc. ALL of those being failing and all is their own fault, they got used to NOT ABIDE by the law when the previous TRAITOR good for nothing was president and did NOTHING to correct their manners

Hey Slick, are you representing Barrick now because what you are saying doesn't make any sense since Barrick is violating the local customs laws by saying that the gold is originated from the USA when it comes from this country. Just because someone runs a red light and doesn't get busted that does not give you the right to also do it and then complaint if you get caught. They made it a big mistake and now they have to pay for it. There are lots of company here in this country that has been fine and some have gotten their licenses cancelled or suspended for doing this kinds on things.

Here are some points from the video:

Contract originated 2001:
- 25% tax on net income
- 25% tax which applies to all companies
- 3.2% royalty based on the price which is placed in a particular market.

Contract changed in 2009:
- No tax on net income until Barrick recovers investment + 10% of investment, so 110%
- No corporate tax either
- Any environmental work by Barrick can be deducted from the country's royalty.
- Contract violates law 146 article 123 which states that all mining operation should afford the country 40% of profits.

Current events:
- Barrick conveniently states that "we don't have the capability to separate gold from silver in this country" so they ship out Dore.
- Dore goes out without being tested, so we don't know if they're exporting 10% gold or 90% gold when it's weighed.
- Origin is being reported as USA so that these shipments appear to be in transit. So when records are checked our gov wont be able to charge retroactive taxes.

Canadian customs received in the last 18 shipments another manifest.

Every import is verify.

We need to place all export & import manifest side by side.

The severity of the this deal will be verified by how long it survives in the local media.
It is apparent every time something erupts. The bigger the corruption, the more pathetic the stories become, and eventually disappear or morph into complicated heresay. The media is controlled. Everyone has their price. It is all managed. It is all paid for. What we read is what is being fed to the public. We are the public. We are the mis-informed. Our pockets don't get lined. It is deception....just that. We will never know. Do you think anyone here, in an open forum, really has a clue? If you truly do, stand up, identify yourself, and be willing to sacrifice for your cause. The media doesn't cut and paste the cargo manifests for all to see, because they haven't seen them! Cargo Manifests are easy to compare and read. I haven't seen any in this case. Until then, it's just politics as usual. Carajo!!

1. No mining company can separate gold from silver, that is why it is sent to a refinery. That is a completely different process.

2. The dore is weighed and assayed. To say no one knows how much gold and silver is in a bar is ludicrous. The insurance declaration will spell out the value of each bar. Do you think they would ship the precious metals uninsured or under-insured? That is a big risk that no one would take. The value is also declared for customs purposes. There are no reports that the shipment was under-declared. Nothing to see here, move along.

3. I can see no reason to falsify the origin. Probably just an innocent snafu. The financial statements of PVDC are audited by international accountants. A massive scheme to defraud anyone is unlikely.

Keep up the conspiracy theories. There a good laugh.
