San Francisco.- Dominican-born All-Star Game MVP Melky Cabrera was suspended for 50 games without pay Wednesday after the San Francisco Giants outfielder tested positive for testosterone.

Cabrera leads the National League with 159 hits and is second in batting average behind Pittsburgh's Andrew McCutchen. Cabrera's penalty is the first for a high-profile player since last year's NL MVP, Ryan Braun, had his suspension overturned by an arbitrator last winter.

Major League Baseball said Cabrera tested positive for the banned performance-enhancing substance in violation of the drug agreement between owners and the players' association.

"My positive test was the result of my use of a substance I should not have used," Cabrera said in a statement released by the union. "I accept my suspension under the Joint Drug Program and I will try to move on with my life. I am deeply sorry for my mistake and I apologize to my teammates, to the San Francisco Giants organization and to the fans for letting them down."

50-60 million down the drain for him. Will need to once again resurrect his career and teams will likely only offer one year options going forward. Next time hire Braun's lawyer.

Baseball Fires Arbitrator Who Overturned 50-Game Suspension
By KEN BELSON

Published: May 14, 2012

Less than three months after Major League Baseball objected to the overturning of Ryan Braun’s 50-game suspension for a positive drug test, Shyam Das, the arbitrator in that case, was fired, according to a person in baseball with direct knowledge of the decision.

Ryan Braun's 50-game suspension was overturned by the arbitrator Shyam Das, who was fired by Major League Baseball on Monday.

Braun avoided a ban for violating baseball’s drug policy by convincing Das his tests had been mishandled.

Braun became the first major league baseball player known to have won an appeal of a drug suspension when he convinced Das that his urine samples taken in early October were mishandled by

by a drug collector. The collector waited two days before shipping them to a testing laboratory, rather than on the day they were collected, allowing Braun to question whether they were tampered with.

Rob Manfred, the executive vice president for Major League Baseball, vehemently disagreed with the decision and defended the league’s collector in the case after Braun raised questions about his integrity."

Braun's testosterone levels were the highest ever recorded by MLB!

"With drug testing, there are only two classes of athlete: those caught, and those not caught. Braun is now in the second category, the category of the un-caught.

We have every reason to believe that athletes can dope and get away with it. Consider the evidence. Barry Bonds never failed a drug test. Neither did Marion Jones. Numerous cyclists, from Floyd Landis to Tyler Hamilton, are confessed career dopers and were able to get away with doping for years. There are plenty of PEDs for which there are no tests, or where the tests never seem to actually catch anyone. As Victor Conte recently pointed out, some PEDs are so fast-acting that they clear in a matter of hours – unless MLB wants to conduct surprise tests at 3:00 a.m., an athlete can use these drugs without fear of being caught. Conte thinks that 30-40% of baseball players are using PEDs, and while that’s obviously a wild guess, it’s a wild guess by an expert that knows a lot about the subject.

Sorry to be so gloomy.

But having won his case, Braun gets to be classified with the other 1,196 major leaguers who tested negative in 2011. He may have doped. He may not have doped. Baseball couldn’t prove he didn’t dope. That’s the best we can say about anyone subjected to PED testing, including the squeakiest-clean baseball player you might imagine."

Conti should know.

How can one fairly compete amongst cheaters. It is tough not to cheat when everybody else is cheating, otherwise you end up at the bottom half of the class.

This is why I don't defend scumbags, no matter what national or cultural affiliation we may share. The cover-up is most always worse than the actual crime. He should be banned for life.

Atabey,

Please read up on the Braun story, I don't think you have the facts lined up. EVERYBODY connected with baseball knows that Braun is a cheating scumbag including MLB, the writers, the fans, his mother, EVERYBODY. He got off on a technicality, that being that the collection of the sample was not followed via the CBA protocol. The MLB rep. who took the sample did not turn it over to the designated collection locale in the required time, instead he took it home over the weekend and surrendered it the following Monday. That violates the terms of handling the testing samples as stipulated by the MLB/Players Union. Braun got off on a technicality but he didn't get off in the court of public opinion where EVERYBODY knows he is a cheating scumbag. I want a clean game as most people do, the only way that will happen is for the cheaters to be severely punished, fanancially ruined and jailed for breaking the law as well. Defending cheats with "everybody does it" will only keep it as is.

I have read up and know very well that he got off on a technicality. It still doesn't take away what guys like Conti-who knows more about PEDS than you or I will in our collective lifetimes- says about current PED use in major sports. Science is winning the race. Only idiots who take risky chances get caught. The "clears" are out there.

Ata,
I agree that Conti knows more about cheating and doping than we ever will. That said, Conti is also a proven liar and convicted felon who in his latest incantation know wants to be the "savior of sports integrity". He always says what suits his interest, he did so as a cheater facilitator and now as a supposed "savior". I take what he says for what it is, self serving rhetoric. That is not to say there are some, perhaps even many, many athletes who cheat and are never caught, let's make an example of those caught, financial ruin and incarceration, instead of a slap on the wrist and forgiveness by those that feel some sort of insipid affiliation to the guilty....

Devin11,

Sports are entertainment. Period. End of story. It's like the Miss World or Miss Universe Pageants, it's all about bringing in the crowds and selling stuff. The longing for 100% unadulterated sporting competition has forever been a false paradigm. It's like wanting to still believe in Santa Claus or the Tooth Fairy. Never has there been a period in Baseball history when some players or many did not stretch the rule book. And that includes all sorts of shenaniganisms- secret or dishonest activity or maneuvering. Sometimes by the same ownership groups.

So yes, fined them and let life continue. Life is more gray than white or black. And I say that not to be rude.

The fast acting testosterone that Conti talks about is probably one of the most abused PED in the game today. Melky got caught because he's a bone head. MLB got into this fix when because of the troubles from the cancelled shorten season that saw many fans walk away from the game and sent gate

numbers crashing after the debacle, management took the stand-never official of course!-that they would see no evil and hear no evil. Just get them people passing the gates and paying for the entertainment value of the games. And so it did, home runs went up and a great race for the Home Run title got going in 1998 with Big Mac and Sammy providing the most entertainment in years. Baseball was back! The cash was coming in faster than they could count it. But then it got ridiculous -something had to be done. Puny lead off hitters hitting 40-50 HRS! Jesus! So things had to be adjusted and of course the players would be used as sacrificial lambs. No ownership group said: we are responsible too for this state of affairs.

I still watch the sport I loved coming up as a child, but think of it as mere entertainment. Love to see young guys like Manny Manchado of Baltimore and that wonderful center-fielder from the Angels, Trout. Man that guy is the second coming of Mantle!

This I find really troubling:

Atabey,
I'm aware that baseball as most sports are entertainment, that has always been the case, otherwise there would be no audience. Sammy Sosa and Mark Mc Guire were not the saviors of baseball, they were the destructionists of the modern game who only acted out of complete selfishness for themselves. They were the most advent precursors to the invalidation of the historical statistical integrity of the game. Ruth and Mantle hitting homeruns fueled with whiskey and beer or the following generation on barbiturates, spitters or nail files is no comparison to the designer drugs and masking agents used today. Lowering the moral scope for these current cheaters is completely in line with validating their unscrupulous character. I'm not being naive, I choose not to root for people with an unfair advantage, much like yourself when the issue involved Oscar Pistoris, you vilify him for an unsubstantiated advantage but have no problem giving a pass to these proven cheaters.

There are many people that get away with all sorts of criminal activity, does this mean that when one is caught they should be released with a slap on the wrist and a promise not to do it again? Of course not, don't worry about the ones that get away, try to catch those tomorrow and punish the ones that were caught today. There is plenty of blame to go around but the players union is the biggest block to putting a more comprehensive testing program since they are paid directly by the cheaters to protect their non-existent integrity. The ownership is too afraid of losing their anti-trust clauses from government legislators to oppose more strict and regimented testing changes. The everybody does it, so everybody should do it arguement defies logical sensibilities and is an insult to all decent people. Would anyone give a pass to their children lets say if they presented that as an explanation of abhorent or illegal behavior?

"much like yourself when the issue involved Oscar Pistoris, you vilify him for an unsubstantiated advantage but have no problem giving a pass to these proven cheaters."

Oscar Pistorius has his Special- Paralympics- Olympics as an outlet. So it's not the same.

Look again, it looks like another attempt to bring more entertainment to the games.

"In November 2007, Pistorius was invited to take part in a series of scientific tests at the Cologne Sports University under the guidance of Professor of Biomechanics Dr Peter Brüggemann in conjunction with Mr Elio Locatelli, who was responsible with the IAAF of all technical issues. After two days of tests Brüggemann reported on his findings on behalf of the IAAF. The report claimed that Pistorius's limbs used 25% less energy than runners with complete natural legs to run at the same speed, and that they led to less vertical motion combined with 30% less mechanical work for lifting the body.(34)In December, Brüggemann told Die Welt

In December, Brüggemann told Die Welt newspaper that Pistorius "has considerable advantages over athletes without prosthetic limbs who were tested by us. It was more than just a few percentage points. I did not expect it to be so clear."(35)

Based on these findings, on 14 January 2008 the IAAF ruled Pistorius's prostheses ineligible for use in competitions conducted under the IAAF rules, including the 2008 Summer Olympics.(36)

Pistorius called the decision "premature and highly subjective" and pledged to continue fighting for his dream. His manager Peet van Zyl said his appeal would be based on advice from United States experts who had said that the report "did not take enough variables into consideration".(37)

Yet these scientific facts were overturned! Guess what? More entertainment.

"Oscar Pistorius has his Special-Paralympics-Olympics as an outlet. So it's not the same."

Well I would remind you that Melky particularly as a career below average veteran ball player sans illegal "enhancement" also had many outlets, including, the bench, minor league or foreign professional participation that would have been more in line with his true organic athletic ability. So, it is exactly the same. Melky, just like Oscar wanted to perform at the top venue of their respective athletic disciplines, to maximize exposure and wealth. However, you vilify one and not the other, which is an obvious double standard.

After the above report you cited, Pistorius appealed and won after presenting his case to the Court of Arbitration for Sports. Among the doctors and engineers from no less tha SIX UNIVERSITIES that overturned the initial ruling was Dr. Hugh Herr, an MIT Media Lab professor and director of the Biomechatronics Group, who presented scientific facts against any special advantages. As you would say, "Dr. Herr (who is know as the foremost Biomechatronics expert in the world) knows more about this than us" and based on the finality to which his judgement rendered and was accepted, he knows quite a bit more than the gentleman you quoted. I guess that these experts can agree or disagree and so can we laymen but I don't think you can find an expert who will claim that Melky did not benefit from his proven illegal activity.

Please consider that when Pistorius was not allowed to compete he sought the legal remedies that were available to him and he won. Whether you agree or not with the findings, he went about things in a transparent legal manner. Everything Pistorius did was above board, he didn't do anything behind the backs of the governing bodies of the applicable organizations. Melky on the other hand did everything he could to to circumvent the laws and orginazations set up to catch cheaters like him, he also tried to cover up his indiscretions with further deceit and illegal actions. Yet you vilify the guy that acted within all legal bounds and wish to give a pass to the guy who cannot be defended by Darrow himself. I don't get it Atabey, I just don't get it.
