SANTO DOMINGO.- The Constitution Revisory Assembly on Tuesday failed to clarify the ambiguous Law 305 on Coasts and Seas which doesn’t specify the citizens’ right to access their beaches, coasts, rivers, lakes and lagoons, rejecting the proposal to benefit from them, "without jeopardizing property private."

The text, rejected with 95 votes for (100 were needed for approval) and 54 against stipulated that “without jeopardizing the rights to private property, the national beaches and coasts, rivers, lakes and lagoons, are of free access to the public, in the conditions and forms the law determines."

Adding to the confusion, the lawmakers disregarded the agreement on the controversial legislation by the heads of the ruling PLD party, Leonel Fernandez, and of the opposition PRD, Miguel Vargas.

In that regard, the spokesman of the PRD’s deputies Ruddy González requested a revocation of the voting and a "recount" in today’s Assembly session, alleging that his colleagues "mistook" the motion by voting against it.

Most of the country’s major hotels place armed guards along the beach to keep non guests from using the swath Law 305 describes as “a strip marked by the high tide line and 60 meters inland, access to which cannot be impeded, without jeopardizing property private.”

It was funny before when I would take any girl that I was dating to the beach. But now that I have a fiance that I actually care about, its not funny anymore

This is not just a Dominican Law. Most countries have the same law. The beach belongs to us all as to our Parks. Rivers and, Lakes. Unless on private property. I can see the reason for this to keep the riff raff out. However, If we all pay our taxes we should all be able to enjoy a walk on the beach. I remember years ago they used to have rope strung across. Where one could not enter without being a guest of the hotel. It also kept the vendors out too. Seemed more affective.

went to playa dorada one day went on the beach my god i thought i was going to be SICK. who the HELL WOULD EVEN LOOK at them?.... no tops, this is the only time in their life they can get some GUY to look at them TOPLESS., VERY FAT, VERY UGLY, AND I GUESS VERY STUPID AND HARD-UP

Reality is, most resorts control the beach 20 meters from the HTM. Technically any facility they place within 60 meters is on public property, thus they really have no control over the usage, although few understand that. If I wish to lounge under a palapa....ain't shyte they can do about it.

But...try it, and Politur is called in to move you along....even they do not understand the law.

The HTM boundary is quite universal. Notwithstanding that fact, lack of education makes things a triffle fuzzier on the Dominican side of Paradise. Were not for those John Wayning heavily-armed illiterates patrolling those illegaly privatised beaches chances are you'd be mugged, raped or worse much before the sun sets down. But don't you worry, dear chaps. Before the sun splendidly brazes the Caribbean waters, chances are you had had to stand for hours, hiding under your palapa, stiff as a bunch of plaster, pretending to be impervious to the swarm of hookers, coconut peddlers, dry-.pissed cashew nut sellers, weird Christian missionaries and eager souvernir sellers. See what has happened to Boca Chica. One of Errol Flynn's favourite spots. A wonderful, neat beach with that La Matica outdoor aquarium. All gone to the pot, polluted and dangerous. Poor Dominicans, deprived by their Government of what makes men truly human: Education.

starting to look like nazi germany in the dominican republic, I never seen any arm guards in beaches in the united states . the united states rather have a rent a cop unarm getting paid 8 bucks and hour . just to save money ,they keep this up we might start we might be going back to the trujillo days
