Santo Domingo.- The government of the Dominican Republic on Thursday laid to rest the fears of a major land theft in the Southwest region, where individuals with forged titles sought to take over Bahia de las Aguilas, one of the world’s most pristine beaches, and announced an investment of US1.5 billion by U.S. developers.
The announcement however also accepts the fact that many titles which originated in the fraud would be recognized as legitimate.
In a National Palace press conference which began 12 noon, the Presidency’s Legal adviser Cesar Pina, and the ministers of the Environment Bautista Rojas, of tourism, Francisco Javier Garcia announced an ambitious project to develop the Southwest with Pedernales at its center, taking advantage of the region’s vast biodiversity, recognized as such by the United Nations.
Garcia said the studies in and around Bahia de las Aguilas started several months ago and took into account the sectors concerned with the environment. “But there’s been some confusion regarding the proposed development.”
He said the project seeks to develop the Southwest, “which other presidents have had to deal with.”
He cited a 2001 decree of former president Hipolito Mejia to form a similar commission including the declaration of eminent domain over the lands, “but it was revoked because the State doesn’t have to expropriate lands which it already owns.”
He said if the normal proceeding were to be conducted to recover the lands that figure in the hundreds of title, including some that were forged, ”it would’ve lasted as long as 60 years. The south region cannot wait that long.”
“The south doesn’t have any other resources except natural ones,” the official said, but affirmed that Bahia de las Aguilas will be left totally intact.”
He said the area will be developed placing Pedernales at its center, with the three other provinces of the Enriquillo region, including Barahona, Independencia and Bahoruco.
He also announced an investment of US$1.45 billion by U.S. developers that he didn’t identify.
“If it weren’t for the Government’s indictments in 1997, Pedernales would’ve been developed in an unorganized fashion, mutilating its natural resources,” he said, showing the Territorial Development Plan for the southwest, and cited the work by experts from Costa Rica, known for its advanced ecotourism.
He said Jaragua, Sierra de Bahoruco and Enriquillo Lake national parks comprise the country’s major biodiversity region. “But neither the inhabitants nor tourists take advantage of that treasure. The Presidential commission decided to resolve this problem because the southwest also has the right to development.”
Environment
Rojas noted that 42% of Pedernales territory are protected areas, which he also affirmed wouldn’t be touched by the development projects. “Bahia de las Aguilas will be totally protected, just as Isla Saona.”
“We guaranteed that every project to be developed in Pedernales will be duly classified under the management plan and terms of reference for every request.”
“We guarantee the Dominican people that not one inch of Jaragua and Sierra de Bahoruco will touched by this development, “so the people can enjoy this biodiversity.”
Legal Adviser
Pina said the transactions leading to the elaboration of the development program sought to advance the land expropriation process, stemming from the various types of exchanges after the Dominican Agrarian Institute’s designation of areas in and around Bahia de las Aguilas, as an agricultural homestead in 1996.
He said the government intensified the case against the land fraud in 1998, but noted that the proceedings “were expected to take an extremely long time.”
“If we were to await the process to unfold in the courts, I wouldn’t even venture a guess as to how long it would take.”
“That’s the reason why we sought out those who had deeds recognized by the State to proceed with a transaction, because if we were to start an authentication, again, would be an extremely drawn out process.”
“This allowed the State to become the sole claimer of the lands and therefore proceed to seek investors.”
Pina said titleholders will obtain 45% of the land values, while the Government’s part will be 55%.
The official said a trust fund will be established to pay the titleholders their share.
He said the trust fund will be highly effective and includes the reception of the transfers “but the State’s portion of the funds will used exclusively for the region’s development.”
“It’s no surprise to anyone that ecotourism is the type of tourism which Dominican Republic needs most.”
Pina said the trust fund is the most transparent manner to manage the expected resources, adding that the program encompasses “two totally legitimate procedures.”
He announced a call for tenders to establish the trust fund, but acknowledged that there are no specific figures thus far.
Fraud
In the CDN TV program, the environmentalist Laura Acosta said the announcement constituted “the biggest land fraud in the country’s history.”

Big mistake. I am sorry to see any development allowed, no matter how limited it may be. This is a treasured area of the DR and should remain undeveloped for eternity for all future generations of Dominicans to enjoy. Whatever local structures that may exist should be carefully removed and the owners compensated by the Dominican government, only if they built with "special permits". Just my humble opinion.

Decision reeks of ineptness.
It is unbelievable that in a country ruled by decree, the government would make such a lame excuse as to state that it would take more than 60 years to clear up the court cases from the usurpation of the national patrimony by a few corrupted government officials and their cronies. It should be very simple. The gov't should know what has been owned by the state since the proverbial "Cuca and Rotetan". Kick the thieving bastards out and prosecute them for crimes agaisnt the state and the Dominican patrimony, and send them all to "La Victoria" not "Najayo".
What lack of judicious leadership! The national patrimony is not for sale or hose trading or negotiable in any manner. Wtih this nebulous action, in my opinion, the administration in general and Medina in particular, have lost much of the people's faith, and justly so.

You got me beat on all counts. I come from a poor family from El Cibao.
Not one of us made it in the business world, and I love Opera but not a single member was ever musically inclined.
As far as my accomplishments are concerned, I did not make it to the top. I studied hard and worked hard, but most of my $$ lost due to stupidity and my trust in people.
I also try to make light of life since, in my humble opinion, it's to be enjoyed, not rued about. If my feeble attempt at humor rubs you wrongly, I'm sorry. I'm deluded into thinking to be a comical riot and often times, literally, dream about funny stuff to which I wake up laughing.

Since I don't, I can't add an opinion that has validity.
What I can say about it, though, is that your questions are hard to answer. This is due simply to "variances", if you will, on the locations, facilities, (water, power, etc..), topography, price, access, etc, etc.
I think a well-run business can succeed anywhere in DR, provided all of the above are taken into consideration.
I want to be part of it, and will have to get thru uncovering feasibility, legalities, location, and so many more details that are hard to consider/imagine, unless one is there to see and feel.
This is what common sense tells me. But what do I know!?.. ...Guess I'll find out when I cross that bridge.

Not cynical at all, MJ, What I am is a person with many faults, but to my advantage, I recognize them and try to correct them. However, it isn't easy. The emotional part gets the best of me, oftentimes, before I’m able to hold it in check.
I tell you this because, I think one trait of stupidity common in most of us, is to think emotional outbursts will make for a better strategy in debating an issue. This leads to misunderstandings and the loss of “respectful and intellectual discussions”.
If I come across as condescending or contentious, no, on the former; yes, on the latter. I try to chat and learn from everyone, but some “get my goat” and I respond in kind, something that kills the opportunity to have fun and gain knowledge of in the process….We can win much without the need of a “sword”.

Being who I am, a closeted old fart with few friends, and even fewer with whom to chat and learn from, is what drives my desire to trawl the ‘net in search of thinkers to argue and bicker with, if only over insignificant points. So, I don’t mind telling everyone, that I do this out of a necessity for such. And to fill time and bring meaning to an otherwise empty life. .This I mean, in the sense that most of us crave peer companionship, if even in cyberspace.
I think life is a constant wrestle with reality and must be examined and upgraded as needed. Since I don't, I can't add an opinion that has validity.
What I can say about it, though, is that your questions are hard to answer. This is due simply to "variances", if you will, on the locations, facilities, (water, power, etc..), topography, price, access, etc, etc.
I think a well-run business can succeed anywhere in DR, provided all of the above are taken into consideration.
I want to be part of it, and will have to get thru uncovering feasibility, legalities, location, and so many more details that are hard to consider/imagine, unless one is there to see and feel.
This is what common sense tells me. But what do I know!?.. ...Guess I'll find out when I cross that bridge.

As for Felix, the mailman, he died of cirrhosis, so now I get my checks deposited directly into my account.

And for the record , even though we cyber giants that claim to have balls bigger than our egos are only here for the entertainment value lol , I must admit that the primary reason I occasionally participate on these forums is because its hard to find true, deep intelligent dialogue almost any where I roam , especially in the D.R and its the true intellectuals like yourself who not only provide
knee smackin jollies , but actually challenge me to look deep inside of myself at painful truths Id rather not encounter while forcing me to question my own motives and purpose in this world ..

Being who I am, a closeted old fart with few friends, and even fewer with whom to chat and learn from, is what drives my desire to trawl the ‘net in search of thinkers to argue and bicker with, if only over insignificant points. So, I don’t mind telling everyone, that I do this out of a necessity for such. And to fill time and bring meaning to an otherwise empty life. .This I mean, in the sense that most of us crave peer companionship, if even in cyberspace.
I think life is a constant wrestle with reality and must be examined and upgraded as needed. For this, one needs steady stimulation, and what better way to do so, than to discuss issues, that in itself can help us understand much and compel us to effort mid-course corrections, as we travel on to our final destination.
I’m happy to know my initially offensive blur did not result in lasting anger and, that because of your understanding, were able to exonerate me and excuse the true a-hole that I can sometimes be. The biggest challenge we face, as you affirmed, is that we need to question our motives and purpose in search for what drives us, and to learn from it….so that stupidity lapses can be kept to a minimum.

You know, Josean, I promised myself I wouldn't deal with you again. But, thinking about it some, you may be right about me getting too deep in analyzing life and other shitty issues.
I don’t want to be a philosopher, or a “Dr. Phil”. I just want to be someone who sees things for what they are without prejudices, biases, and make judgments that will favor my future with no harm done to anyone else.
I believe you’ve taught me a lesson here. And that is to avoid trying to explain things when I don’t understand it myself. I get to thinking too much and in the end, not making much sense.
