Santo Domingo.- The Constitutional Court (TC) on Thursday upheld a lower court ruling for a group which for several years claims ownership of the exotic island Cayo Levantado, Samana (northeast).
The group had challenged the Supreme Court ruling of August, 2012, for Inversiones Whale Bahia, S. R. L., operators of the Hotel Bahia Principe Cayo Levantado, claiming that the decision will cause irreparable damage.
But the TC refuted the claim, ruling that its enforcement ordering wouldn’t lead to such damage, since it cannot serve as a title to dislodge and take possession of the property claimed by the successors of the late Andres Trinidad Mejia.
The San Francisco Appellate Court’s Civil Chamber had ruled to acknowledge the heirs as the island’s owners headed by Dante Trinidad and Manuel de Jesus Linares Santana.


1) To be fairly compensated by the delevlopers/owners of the Hotel and the DR Government that issued the fraudulent/mistaken permits to everyone. Plus compensated for loss of use and legal fees.
or
2) have Cayo Levantado remediated back to it's original virgin/natural condition at the cost of DR Government (Sec de Turismo). Plus compensated for loss of use and legal fee.
I would imagine, that the property was homesteaded at the time land grants issued by the DR government, to settlers/farmers of that era, as much of the Samana Peninsula was.
