New York.– Benny Delgado, a paroled murderer, was arrested Monday for fatally shooting a Bronx livery cab driver of Dominican origin, the second driver killed on the job in a week, police said.

Jose Peña-Segura, 42, the father of four daughters, died at Lincoln Hospital at 11 p.m. Sunday, less than an hour after he was shot in the head during a robbery attempt in Mott Haven, police said.

Career criminal Delgado, 31, fled the scene but had not gotten far when he was caught carrying the revolver believed to have been used in killing, cops said. Delgado, of the Bronx, was hit last night with a second-degree murder charge as well as felony raps for criminal possession of a weapon and assault, cops said.

The suspect –who has more than 20 arrests– was released from prison in 2007 after serving 12 years on an attempted murder conviction. Investigators believe Peña-Segura, was flagged down by Delgado and two other men near St. Mary's Park - and one of them immediately brandished a .25-caliber revolver, police said.

When Peña-Segura refused to hand over his money, the gunman opened fire from the backseat. Witnesses saw the three men run from the cab moments after the shooting. Delgado was stopped in St. Mary's Park, police said. The two other robbers were still on the loose last night.

"Jose was a very good man," said his wife, Natalia Espinosa, speaking through tears. On Aug. 16, livery driver Amadou Ndiaye, 46, was shot through the heart and robbed by a passenger while driving in Baychester. His killer remains at large.

how difficult it is for a man to earn edhis living from his own sweat. in a perfect world all these human lacras would had been sentenced on the spot. i used to play baseball in a league at st mary park during my teen year. this section of the bronx mott haven had been one of the worst area in all new york for the longest.

" DOMINICANS DON'T PLAY "

Members: Estimated in the hundreds

Ethnicity: Dominican

Origin: The fastest-growing gang in The Bronx, it also boasts one of the youngest memberships - most 15 to 17, cops say that way there is little chance of a conviction....

Tools of Choice : The machetes.

Turf: The Bronx

Oh yes Grosero, that will sure help things.

While Dominicans definitely need to look out for each other, soliciting street-gang protection or revenge killings does nothing positive for our community. May I also remind you that DDP (as "patriotic" as they may want to be seen) actively war with Trinitiarios, another Dominican street gang.

These thugs do not help the Dominican community nor its image.

This story really angers me.

Here is a man earning a hard-working living and this obvious loser, a horrible product of a really dumb and benevolent system, ends his life while in commission of a robbery.

Really, system needs to be reformed on side of justice. These losers, like Benny, should be locked up permanently and the key thrown away. Perhaps we should farm them out to prisons far away, such as Russia or some other eastern European country. That would be justice.

Grosero,

You've convinced me that we [Dominicans] have arrived, but in a regretful way.

As for young criminals populating gangs, that's exactly what they are: criminals who just happen to be young. Forget age. Try them as adults and given long sentences. And, if they are not citizens, deport them. That would be justice.

This is another horrible story. Here is a man who I am sure would be more than happy to surrender whatever he had in his pocket to this vermin, but the lifetime criminal had to shoot him.

Another family to be raised without a father.

Sad. It's just sad.

My condolences.

R.I.P. Jose.

The US really needs to decide once and for all how to deal with these violent criminals.

I've been an avid opponent of State-sponsored death penalty, but I don't know?...

...Maybe we should start handing these low-lives over to the families?

It's not 1st degree murder YET. After they charge him with robbery and use of a hand gun in the crime it becomes a capital murder and they CAN seek the death penalty. Thry just need to put a .357 in tha back of his head and send his family the bill for the bullet!!

Most Career criminals do not mind jail, If it was Hard labor then they would get jobs instead of stealing or killing for money...
