New York.– New York cops accused Cesar Rodriguez and Jose Peña of having crack cocaine in their work van, but it was only coconut candy. Though charges were dropped after tests, the two Dominican men plan to file a US$2 million suit against the NYPD.

The night of January 15, as Peña, a 48-year-old plumber, and his longtime pal and colleague Rodriguez, 33, were headed to a party, they decided to stop at a bodega on 181st Street and the Grand Concourse.

When they came out, cops were waiting and asked to search their Ford minivan. "I said ‘Go search.’ I even opened the door," Rodriguez told the press. An officer rummaged around, came out holding a "Hello Kitty" sandwich bag, and shouted "Bingo!" the men said.

"It’s only candy!" Rodriguez said, as the cops handcuffed him and Peña, and several other police cars rushed to the scene. Rodriguez said he buys a 50-cent bag of Coco Candy, a hard coconut-based treat, almost every day. Because it easily crumbles, he puts it in a sandwich bag.

The two men were jailed for crack possession. Peña got out after three days, but Rodriguez was held two more. The Bronx District Attorney’s office confirmed that the case was dropped after authorities realized there were no drugs.

I know a guy that had an open bottle of malta in his car and the cops made a huge deal saying that it had alchol in it

xwill7, this is yet another case of racial profiling. It happened and still happens to me all the time while driving around in my 65k plus car, which I work like a dog to pay for it every month. The interesting thing is that they never stop my wife since she look Italian to them, but the Dominican guy can never own such car if he is not selling drugs.

That is one of the thing that we always complaint about to our local leaders to step up to the plate and deal with the race issue here. Also, this is the reason why I do not discriminate or think of any other race to be less than me, since I still experience profiling. Finally, the most funny part is when people hear about me, but have never met me, and the day they do, you can see in the surprise in their face that I am Dominican, idiots.

Anyway, it looks like a shakedown gone south. 3 days until somebody finds out it is candy?

Good luck with the lawsuit, guys. They deserve it.

xwill7, no they pull you over and put you under arrest, only when you arrive to the police station they'll carry out what ever testing they need to. Moreover, if you get lucky enought and get arrested on friday, then you'll spend all weekend in the hole and on top of that, if the precint does not have the equipment needed to conduct testing, then you are in the hole until the results come back.

It is not recommendable to be so blunt around here my friend. There are some trolls that are constantly patrolling looking for things that do not fit our mental illusion about who we are and will simply yank it out.

These guys may have a case. The cops needed probable cause to search the van. This means, was there some alert to them about a van or the occupants, that this van and/or Rodriguez and Pena matched the alert description. If so, the police were justified to inquire. If not, the police were out of bounds.

A ten dollar retail kit to street test for cocaine is available to law enforcement authorities, you drop a sample of the suspect substance into the liquid chemicals of a small vile, if the chemical turns blue, the substance is cocaine, you make the arrest.

ZOOMA: Actually it says that the Cops asked permission and the guy gave them permission to search the vehicle. They encountered the guys coming out of a store and didn't make any type of traffic stop either. So at that point they don't legally need PC for searching the vehicle, it's considered a consentual search. However, I completely agree that these guys have a good reason to sue the city. The cops should have Narco Field Testing kits with them to make initial verification before they actually make an arrest, or at least have them at their station for use. Keeping them in jail because the city is too cheap to provide the proper tools isn't an excuse for that BS. Ofcourse, if they win, I'm going out and buying some F'n Coco Candy and see if I can cash in on that deal...

You don't need probably cause if you have permission to search the van. I bet there is more to this story than is posted here. Too bad it is a one way story. They were probably just being Dominian and parking in the middle of the street blockin traffic in both directions while going shopping and SURPRISE the police didn't like it. Decided to treat them in the same uncivilized way and put their butts in Jail.

I'm just waiting for that opportunity to retire from work , a couple of idiots in blue uniforms making the big mistake of their stupids life of accusing me of drugs traffic because I have something that looks like drugs to them.

How stupid could you be to arrest a person with such fucking excuse ? Boy my lawyer is going to chew your ass to the end of it.

What a ignorant motherfuckers are those police officers. lol.
